I have warned of a possible lawsuit against me. They said they are no longer obligated to provide proof of my loan as my account has been "sold" and they have attempted to reach me in the past. I don't have any proof of this alleged loan but I am being forced to either pay now or accept a lawsuit. I DID take out a loan with them three years ago...I could've sworn I paid it back. BUT, I don't want to admit to anything unless they provide PROOF. I was told the proof is the fact they have my social security number and my address but they won't provide proof unless I show up in court.

Is this legal?


The third party collector, is required to validate the debt at your request! Not the original lender if they sold it! All that means is to provide how much you owe to whom and from when. Even the when is questionable. They cannot threaten a suit if they have no intention of carrying it out under most state laws. Who is the Collector? Most states also have laws regarding collection that parallel the FDCPA.

This is the email I received. It did not arrive on any letterhead or anything. I asked repeatedly for proof of the loan and I was told the only way I could obtain proof was to deny the loan and accept a lawsuit and I wouldn't receive the proof until I was in court. Or I was to pay immediately and accept all charges against me.

Hi OP,

Can you tell me the name of your state where you reside? I need to know if the original PDL company is legal in your state. Moreover, as Paulmergel said, no legitimate CA will send you legitimate documents to validate the debt via mail.

I need some help!! I found out two days ago that my mother has two liens on her house from this company AIS LLC. My mother is in a vegetative state and I am her legal court rep. All of her SSD and Federal Retirement goes to her nursing home. I am in the process of the sale of her home so she can get medicaid but it wont sale as a short sale if there are liens. Medicaid will not be approved if she still has this house. I am not sure if I want to call from my home number or even give them my name and info, not knowing if they will try to attach my name to this loan. Please advise.
