Do these PDL contact references once you default?

OK...I'm closing my account and trying to settle with these companies...I'm wondering
how much they call and if they call your references?


email them, i would email them anyway just so they get it sooner and than if you have a physical address, mail it certified (so you have tracking information)
do not use a work email as they will threaten to use this against you and it is just less stressful this way.
some companies do contact references, some do not.. i guess it depends on if they can reach you, etc.

What makes you think they are going to honor that? They didn't follow the laws to begin with, why would they start now? Besides, I am quite certain that law applies to solicitation type of calls and not credtors. Though I will admit I need to review it more carefully.

the TCPA requires that a business maintain and honor a "do not call list" of people who do not wish to be contacted by telephone. You're right about them possibly not honoring it, but at least if you send them a Certified letter saying that you don't want to be called and a number associated with them calls you it provides more evidence that they are illegitimate than saying "this strange lender online who won't give me a contract says I owe them money".

The TCPA created a Do Not Call List with regards to telemarketing calls. It does not cover collections calls, charities, political, surveys, ect...

You can tell a 3rd party not to contact you via the telephone and they must oblige under the FDCPA, but in most states 1st party collectors are immune from the FDCPA. The real problem is that most unlicensed IPDL's also use unlicensed collection agencies which means that they have no regard for the FDCPA anyways.
