Since I've closed my bank account and they couldn't withdraw their payment last Friday, I'm sure that she's calling with threats. Since ipdls are illegal in my state sound like no reason to worry?
Can I get some advice?
So I've only been in default for 1 week and the phone calls and emails have started coming in.....Do I answer the phones and return the calls or just ignore them? Once accounts are turned over to a CA do I have to resend the documentation for the C & D, the revocation of voluntary wage assignment and the ACH debit? Can someone please guide me?

well generally a CA can't debit your account,garnish wages or sue.yes re-send your C&D letters.a CA has to comply with the C&D.actually a JDB can take you to court,but a DV and C&D letter usually stops them.in regards to the e-mails and calls.i wouldn't call them back.all they will do is threaten stupidly.you can respond to the emails with your state laws,and the actual amount you owe if anything.
Illegal PDLs
So I'm trying to work through the PDL's I owe and repay the principle that I have borrowed, however, I was in so deep that I am unable to do this all at one time. Do I need to be worried about how quickly I can repay these? I'm trying to focus on household bills and the 2 legal PDL's that I have as a priority - the legals are PDOne and Think Cash. THe rest are illegal IPDL's.

The illegal ones usually will not abid by the C&D letters. Because harrassing, threatening, and intimidating you is all they can do to try and get their money. LOL.........wait til they threaten you with being arrested, possible felony charges for internet bank fraud, filing suit, garnishing your wages, you name it I think they have said it to me. In the end they got nothing more than the principal amount I borrowed and that was paid in payments that I could afford, not what they were saying they would accept for my payment amounts. You owe them, if they want their money they will have to work with you on the terms you can afford and not what they are demanding. Stand your ground and be firm!!!! What else can they do........remember they are illegal!

Does anyone know if Think Cash uses a 3rd party collection agency that might be willing to work out a EPP less than what the original contract states? I talked with Think Cash and they refuse to give at all. I want to take care of this debt, but also need to keep up with my other bills. Please advise...

I am not too sure if they use 3rd party collectors since they are backed by the First Bank of Delaware. They may only do in-house collections since they possess a valid license in DE. Hey but I am not absolutely sure. I know CashCall uses 3rd party collections.
Your best bet is to keep calling untill you reach someone who is willing to listen or take your chances in court. The judge may be a little more forgiving if you have been making an effort to repay. However, it is up to you to prove that you made these efforts. Please document everything you sent ThinkCash.

I can confirm that Payday Loan Yes/Fast Cash is backed by the First Bank of Delaware and licensed in the state of DE and UT. They have an in-house collections department. After 140 of delinquency, accounts there are charged-off, reported to credit reports and sold to a 3rd party agency, usually a lawfirm.

I'm just trying to clarify this information to make sure that I have an accurate understanding? If accounts are charged off and sold to a 3rd party agency (lawfirm) can they pursue a civil suit since the original loan wasn't with them?

Usually an unlicensed payday lender will either hire a bottom feeder type of collection agency or will assign someone in house to make collection calls; claiming to be from "The Fraud Dept" or some other scary title, it's a matter of proving the loan wasn't legal to begin with, I am sure there have been cases (in fact I seem to remember one in this forum) where there are legit CA's whom are unaware the loans weren't legal, in that case you would need to supply all the documentation proving (payday lenders laws, etc.) so. Installment lenders can pursue and utilize the law to the fullest extent.
