Hello Everyone. I took out a loan with Payday Max for $300 about a month ago. Well I had to close my account to get my stuff taken care of with my other PDL companies. Everyone was overpaid except for PayDay Max because they were new. Well I sent PayDay Max my letters (via fax to Credit Protection Depot because that is the only way they would take it) and told them they were illegal/unlicensed in my state, stop all ACH transactions, and that I needed to work a repayment plan out with them. Well when I called to see if they received my letters they said yes and they upper management was reviewing it. Next thing you know, I get a letter in the mail from PDM, except now it's not PayDay Max, it's Professional Debt Management. They are claiming that I owe $600 and the loan was only for $300. When I guy called he was very rude and said I need a lawyer and good luck. He called my cell phone and my work phone. So I emailed them my letters and put 2nd Notice on them but of course I didn't get a response. Then on yesterday, he called one of my references. If my reference tells him that he doesn't know me or that he hasn't spoken with me in years...will they stop calling him? I just want them to stop harrassing me and my references and work out a payment plan with me for the original amount. PLEASE ADVISE!!!!!!!!

Well PayDayMax is definetly not legal they are not even in this country. Have they provided you with an address where you can mail a payment to?

I would just keep sending the email (I sent mine to them someitmes 20 times a day) asking for an alternative way to pay, which they never provided. The best way to deal with them is NOT on the phone. I never once answered the phone when they would call and after a few weeks they stopped bothering me. Make sure you put in your emails you want to keep all communication in writing although I doubt it will help. The more you talk with them on the phone the more they are going to cal you.

Yes I am specifically referring to PayDayMax. there really is not a good way to get them to stop calling your references. They are illegal and so don't follow the laws in regards to anything. They probably will keep ignoring your requests unfortunately. All you can really do is keep emailing them and don't answer the phone they will give up eventually.

Perhaps you can tell your references that it is dealing with identity theft and this is an illegal overseas company and to just hang up as soon as they know who it is or better yet just not answer the phone if that is an option.

Thanks resqume. Shazzers, yes I did receive a letter but of course it was for a doubled amount. Yesterday I actually talked to the manager of the guy that was being rude to me the other day. Of course he apologized and said that they do not tolerate that type of bevhavior and anything that violated the FDCPA. Yeah right!! He also claimed that he wasn't aware that Pay Day Max was not licensed in my state and if that's true then I would only have to pay the principal. He sadi he was going to call Pay day Max and see if they would accept those terms. Are you kidding me, their is nothing for them to accept...he acted as if I didn't know that they worked for the same company. Anyways, I told him that I needed that in writing via email or mail. He started this whole spiel about he is a a manager and he wouldn't risk losing his job over $300 and that he was here to help me. He acted as though he couldn't send the letter. I told him that he wasn't getting any money until I got a letter stating that I only owed $300.

He must think I'm crazy. Correct me if i'm wrong, if i were to send in money and I haven't received a new letter with my new amount, that's like me accepting that i owe the whole $600 since that would have been the only letter I received???/

being illegal they can send whatever they want.so can you.send a letter stating you owe 300.00 and not a penny more.when they accept that fact they will get the 300.00,but not before then.since this is a bottomfeeder include a cease and desist clause in there too.send it certified mail return receipt.

Also, if I tell my references that I am a victim of fraud, then they would still wonder how these people received their info! Sad Wouldn't they?

I guess it depends on how close you are to the references and how many questions they will ask. I am a person of few words, so, my references wouldn't get anymore information than I would want them to tell them. I realize you are different and handle things your way. Sorry, I really don't have any other suggestions other than the one I gave you about "what to tell your references" who are being contacted by these bozos. :?

The best way to stop them from harrassing you is to take the following steps:

put a stop payment on their ACH's to your bank account
contact your bank and make sure they're aware of the situation and that PDM is no longer authorized to access your account.
send their e-mails to your "spam" or "junk" file, and set up your e-mail not to allow their e-mails through.

Eventually they will give up and go after others who are willing to be bullied and scared into paying. Don't let yourself be one of them.

suebeehoney, thanks for the info but I'm way past that. I'm just trying to get them from contacting me and my references while I work out a payment plan with them.

Shazzers, noone has answered the part about if I send in payments before they send me a new letter with the original amount owed then it's like me agreeing to the old terms? I shouldn't send anything until they send me an updated letter that states that i only owe the principal amount, right?
