I have emailed them five time, told them numerous times on the phone and have sent two letters to cease and desisit and asking for debt validation. Yet, they continue and they call me at work, threatening to contact my payroll and HR dept. I know they cannot garnish wages without court order, but I want the calls to stop. In my most recent letter, I informed them that I have reported them to PA AG, PA Dept of Banking and ICA International Ethics committee. What else can I do? This has been going on for weeks, I have no idea what PDL's they are even trying to collect for, they will give me nothing and send me nothing. This is making me sick to my stomach. How long can they keep this up and how long can they try to collect in something. Is there statute of limitations on PDL's?


There is a statue of limitations on contracts (i.e. loans), but that only limits the amount of time the creditor/collection agency has to take you to court to collect on the debt.
You can try suing them for violating the FDCPA, since PA extends the FDCPA to cover collection agencies as well as the original creditor. If you win the company will be fined and may have to pay your court costs and attorney fees.

Obviously they have no understanding of the FDCPA! Here's the thing, pdl's are prohibited in your state, so they assign a shady collection agency to collect on their behalf, Phoenix Debt Management has a terrible reputation, look them up at the BBB, they aren't even listed as a collection agency! You need to file complaints AGAIN and AGAIN against them. When they call, do NOT speak to them, hang up immediately, the more you talk to them, the more they will call, if they have no one to argue with they will tire sooner of calling you. I KNOW how this company works, they aren't even a REAL LICENSED collection agency, they have the very same address as USFastcash and many other Internet payday lenders. Don't argue with them, don't talk to them, just hang up, there is no reason in the world why anyone should subject themselves to criminals like this!

Thanks, they sure do make things very stressful. I have never even heard from any of the PDL's since I closed my account a few months ago. Cash Jar was the only one and they gave me a PIF. None of the others have contacted me. I am not even sure who PDM is trying to collect for. I feel like I am in limbo, always worried what will come in the mail and what can happen. I would be mortified if anyone I work with found out, that is why calling me at work is so stressful.
