Hello Group,
I'm in need of some advice. I have a few active PDL's and I have begun taking action against these PDL's. I have sent out a letter to all PDL's similar to the one here on this forum and have only gotten a response from one so far (PepperCash.com).

such, we are willing to consider the circumstances surrounding your
request. Having reviewed your complaint in detail, please allow us,
however, to clarify a few relevant facts before proceeding to make an
attempt to reach a mutually agreeable resolution in this matter.
Please be advised that Duck Creek Tribal Financial, LLC (D/B/A
PepperCash.com) is a Tribal enterprise, wholly owned and operated by
the Lac Vieux Desert Band of Lake Superior Chippewa Indians, a
federally-recognized Indian tribe and sovereign government (?Tribe?).
Because the Tribe regulates its own consumer financial services
pursuant to Tribal law, state licensure or regulation is unnecessary
and inapplicable to the Tribe, and, by extension, Duck Creek Tribal
Financial, LLC.
Having stated the above, we understand that many people are
experiencing difficult times. So, while we are not obligated to do
so, and in full and final settlement of your loan, we will agree to
consider a work-out arrangement better suited to your current
financial situation. You must contact our call center as soon as
possible to finalize this work-out option. Please be advised that
neither Duck Creek Tribal Financial, LLC nor the Tribe has waived or
intends to waive its sovereign immunity from suit, and this offer to
consider a work-out arrangement in no way constitutes a waiver of its
rights under all applicable federal and Tribal law.
Please be advised that if we do not hear from you in the near future,
your account may be sent to collections. We would much rather work
with you to resolve this issue.

Now that I have received this response what should my next step be? From a $500 loan, I have paid more than 3x the amount back in finance charges. There shouldn't be anything else to work out in my opinion.


It doesn't sound to me like you owe anything, if you have paid approximately $1500 toward a $500 loan. Look at the pdl laws for your state and look up the licensed lenders in your state (a list of licensed lenders can usually be found on the attorney general's website). Also, if you haven't done so already, I would advise filing a complaint with the attorney general's office. Many states are trying to crack down on illegal internet payday lenders so hopefully you live in one of those states. It sounds like you have satisfied the principle and if anything, THEY owe YOU. However, good luck on getting them to refund the money to you. Keep us posted on the outcome, good luck.

well all i will say is this if its on the reservation then how are you gonna send anything to a collection agenecy and since they want to use the law the way they want to. plus what kind of indians are these french canadian? you will be suprise that alot of fake heartless people are started up these type of companies and say they are indians

Well I contacted PepperCash to see what kind of offer they had for me and their best offer was for me to pay my remaining balance, but they would accept a payment plan. This was the exact same thing I was I already doing. So once I declined their offer, they threatened to send me to a collection agency. I informed them that I will be reporting them to my State AG and the Department of Corporations (CA).

This was a week ago, and I haven't heard back from them since, nor has my account been touched. I'm also in the process of closing my account.

I'm in a similar position, only Peppercash didn't bother to respond directly to me. I did, however, get contacted by a Janet Hall at National Credit Adjusters who offered to settle my account for about $800. After I told her that I already overpaid Peppercash by several hundred dollars she basically told me that I must not have read the fine print on the contract and that peppercash "wasn't just going to go away."

I'm going on a week waiting for the validation of the debt at which point I figure I'd just send NCA a copy of the illegal pdl letter that y'all have so kindly provided. Should I do anything else? Is there anyway that NCA can go after me, sue me, etc even though this is an illegal pdl?

I have not heard from PepperCash or any debt collectors since my last correspondence with them. I have how ever been contacted by another PDL (CashInAWink) once they realized they could no longer debit my account. Funny thing, when I sent them a letter I got no response but now that that cash-flow has stopped coming their way, they have been blowing me up, even threatening to contact my employer to garnish my wages. Can they actually do that?

what they mean is a wage assignment.that is voluntary and revocable.to garnish they would have to take you to court,and they would have no shot so they make it sound like they can garnish.drafy a(wage assignment revocation)letter and give it to your HR/payroll person asap.then do not even give them anything but a hang up after that.they deserve nothing else.
