Pay day loan harrasment PA
Date: Mon, 10/22/2012 - 17:24
They keep harassing me at work and telling me they're going to garnish my wages if I don't pay this week $250. I gave them a prepaid card number to get them off my back until I figured this out.
What should I do? I'm in Pennsylvania.
Don't put any money on that card, and honestly, it's probably no
Don't put any money on that card, and honestly, it's probably not safe to use it again.
You need to follow the steps in my signature link. You only had to repay the principal on this loan. You should demand a refund of your overpayment.
please register
please register as you can track replies like mine that not only echo ohiogal's,but elaborate further like.
1)pdl's are prohibited in PA
2)PA is non-garnishment meaning they can't garnish with a court order
go to ohiogal's sticky and follow it to the letter.you not only don't owe,but they owe you and by using the sticky you render this illegal lender toothless.
New Creditor
The people that have been calling me now are RJA Capitol, Inc... They are saying they are the new creditor and Mack Development was the old creditor.
Who do I send the letter to?
Thanks for the help.
If it's a collection agency calling you regarding an illegal loa
If it's a collection agency calling you regarding an illegal loan that you already paid, send them a cease and desist letter. If they've not sent you anything in writing, and won't, just tell them to FOAD.
You don't owe anyone anything.
RJA Capital Inc
The only thing they sent me in writing is that I agreed to pay $250 and this last line...
"If payments are not received as outlined above, this agreement will be null and void and, in that event, the full balance of the above-referenced debt, less any payments made by you, will be due and payable, plus attorney fees and court costs."
I can send them a cease and desist, but do I send Mack Development a refund letter?
yes to both
send the FOAD letter to RJA as they are your typical NY scum scam, and send the refund demand(not request) to mac.do both knowing that RJA can't garnish even with a court order.which they won't get.
Refund
What are the odds on the refund, because the loan I'm getting harassed about is the second loan I had from Mack Development. I paid out about 4 times on each loan. If I get a refund, it'll be in upwards of $2500. Would Mack Development just send a refund, or am I going to have to send them letters every week or something?
You'd have to request the refund from the original lender. It's
You'd have to request the refund from the original lender. It's unlikely you'll get it. You can certainly try but I would cut the loss and move on.
Calls after letter
I cancelled the pre-paid card information I gave RJA Capital Inc and sent them the letter through email. I got a response in email saying to contact the person who was handling my account. This morning I got a call saying I forfeit my rights or something and they're going to send my information to the National Credit Adjusters and have to pay attorney fees, etc... What should I do next?
respond this way
respond like this.
dear maggot infested pile of pdl garbage.i'm through.you nor anybody else can/will do squat to me and if you are not gonna refund fine, but you will be rotting in hell before i pay another cent.i am filing AG,and FTC complaints against you and anybody else you contacts me from now on.
piss off!!!!!!!!!
bottomline nobody who emails,or calls can do squat.stop thinking they can,or will.file the complaints and ignore their sorry a$$.
Non stop calling
So how do I really stop them from calling?
The same guy calls every day and leaves a message saying he's a different person in the company and that I have until the end of the day before a summons is processed. This is RJA Capital and he keeps saying National Credit Adjusters and that I'll have to pay court fees ect... It's funny how he uses a different name like I don't recognize his voice.
I have repeatedly sent the letter to an email and they respond with that I have to contact them by phone.
What's next step?
These are collection agencies. Send them a cease and desist let
These are collection agencies. Send them a cease and desist letter in writing. Tell them specifically you demand no more calls at work. If they call you, collect $1000 FDCPA violation.
Arbitration
I'm getting weird calls now saying something about Arbitration. The number is 716-831-2565

Simply hangup and ignore. If calls persist, invest in an airhorn, as others have suggested. I bet it works wonders!
