Can you be put in jail for not paying payday loans?

Can you be put in jail for not paying payday loans? I have too many store from payday loans and I cannot keep up with them unless I take out more payday loans or use this debt consolidation service. I am worried that these payday loan stores will press criminal charges on me. I have 5 outstanding loans with store front payday loans. I have every intention of paying them back I just cannot make the payments that they are asking for.

you can't be arrested for defaulting on a payday loan, but depending on the state you are in, the legal lenders can very definitely take you to court over the defaulted loan.

Talk to the lenders and tell them you got in over your head, and see if you can work out a better repayment plan with them.

Here is the Payday loan laws for California (just select your state),

What this means is that no criminal action can be taken against you if you default on a PDL in California - HOWEVER....if the PDL company is operating legally in California, you CAN be taken to court if you default and fail to make payment arrangements.

Ok...If a PDL IS legal, in the state where you reside, and they DO take you to court, can they LEGALLY sue for all the % they charge?

What about online payday loans in TN? Can they put me in jail for not repaying a payday loan from over 2 years ago?

Kimmie, If the loan is internet the pdl you borrowed from has to be licensed (and it can be in any state) for them to lend to you. If they are not licensed somewhere, then you are only responsible for paying back what you borrowed. Most pdls, if they are going to take legal action, take legal action in civil court, not criminal court...they do not take you to jail for civil court.

Here are the Payday loan laws for Tennessee (just select your state),..and you will notice it says criminal action prohibited.

I was wondering if you can go to jail for not repaying a payday loan from the internet. A Check was never written they tried to take money out of the account and the account happened to get closed. please let me know

mom,that is one of a pdl's classic threats.what state are you in?chances are what loans you have could be illegal.please let us know what pdl this is,how much borrowed,how much paid total.we can help you here.

Xtina-and all: No, you can not be put in jail for not paying a payday loan. You technically can be sued for nonpayment, and this may be a real possibility for storefronts (though I doubt it),, but a virutal impossibility for Internet Loans. You neet to get organized and list the loans you have outstanding and try to document all payments made to these businesses; storefront and otherwise. On the off chance you get taken to court, I would have copies of any and all contracts; as the judge will be interested in seeing the terms of the loan...and shocked-amused at how they take advantage of you-the judge in my case was and that was a storefront...they claimed I owed them over $2000-I paid them $200. Do not allow these businesses to make you into a trembling victim. Realize they can't arrest you, they can't take your children, they don't have a relationship with your boss to get you fired...they are predators. I know you want to pay them back, but you need to step back for a little bit and take care of things like car payments, mortgage or rent, utilities and food. What is left is what they get, to a point. Do not disclose any of your financial information to these people anymore. For all of you that are scare at this moment, stop and take a minute to think about what is really important-your spouses, your kids. your home, your jobs, and living..stop allowing these creeps to prey upon your emotions and scare you out of your mind..they can't do it..they just like to talk big. During my "time of ridiculousness" I found that I could have a tremendous amount of fun with these idiots...I asked for licenses, I demanded to talk to managers..and yelled so much they couldn't get a word in, they would hang up on me-I would call back. I listed the complaint numbers I had filed, and I had an attorney that happily wrote a letter to Payday Loan Yes. You have the power here, they like to try and make you forget that...you call the shots because you have the money.

the payday loan we borrowed from was Cash Net USA and it was i believe 200 dollars maybe 300 dollars.. none of paid so far. it was done online

even if you didn't file BK.pdl's are prohibited in NC.tell him to pi$$ up a rope if you have paid the amount borrowed.

I too have payday loans out with Cash Net USA and Payday Loan Yes, also one with ZIP19. I have tried to set up payment arrangements with Payday loan yes, but they never took the money out. My account got closed with the bank and I have not opened up another one, and when I tried to explain that to ZIP19 they threatened me and told me that they would have to garnish my wages. I told them they could do that and gave them the info to my HR dept. so they could. I have heard nothing else. But today I get a call from someone (i could barely hear or make out what they were saying) and he was telling me that tomorrow I would get served with papers to appear in court in California, mind you I live in Missouri, and that 4 hours after they serve me with the papers the police will come and take me to jail so I can be transported to Cali. for court on Friday. After going back and forth with him about how they can't send me to jail or to court without serving me with court papers and with them denying me my payment options, he gave me a way to give them my credit card number so that they can take out half today and the rest next week. I must admit I was really scared hearing about hearing this until I got off the phone and thought about it. He gave me a number to fax a paper to him stating that I in no way tried to run away with the money I borrowed and am sending in half the payment right away and the rest next week. Then he gave me this number to call 818.451.4031 when I have sent the fax so he can give me the payment options. Well I never sent the fax but whenever I tried to call the number back I got a busy signal. All he said is that he worked for some federal agency and whenever i asked him exactly what payday company this was for he would just say a federal agency. When I tried to find the number he gave me online I came up empty. So I am wondering if this is real or not. Can they really arrest me and send me to California in just a day for not being able to pay back a loan? Oh yea, the loan was for 400 but they want me to pay back 844.

I borrowed payday loans online and I live in california. I have creditors calling me saying that I committed online check fraud and can be arrested for writing bad checks. is this true? Can I be charged and arrested for check fraud for not paying back the payday loans?

No, it isn't true at all, owing a debt is a civil matter, not a criminal one. What is the name of the pdl lender? Could you begin a new topic with the following info? This way all of your information will be in one place for easy reference and you won't have to repeat yourself over and over, plus it will be less confusing for all of us. Thanks!
-Names of each pdl company.
-Whether they are store front or Internet.
-How much you borrowed.
-How much you paid so far.
-The state in which you reside.

i have a payday loan company that i assumed a loan for 700 dollars in ohio. i was laid off and and tried to call and make arrangements of payments i could and they refused. told me it wasnt enough an they would throw me in jail for the balance on the loan. this was a month ago and that now 700 dollar loan has become 900. can they throw me in jail. it was a store front
