I have researched Internet “payday” loan laws in the state of New York. I have found that such loans are prohibited. The usury laws of the state of New York render this contract void under General Obligations; Title 5, Sections 5-501 and 5-511.

I hereby revoke any and all ACH authorizations to which I previously agreed with Red Cedar Services; www.500FastCash.com or any related affiliates.
Red Cedar Services; www.500FastCash.com or any related affiliates may no longer debit any of my personal accounts, per Federal law, Regulation E Section 205.10 Preauthorized Transfers.

I have closed my account number ending in [Last 4 Digits of Acct # & Bank Name] to protect my interest in this matter, per instructions from the Office of the New York State Attorney General, effective Monday, April 23, 2012.

I also revoke any and all wage assignments I may or may not have signed with Red Cedar Services; www.500FastCash.com or any related affiliates, effective immediately. I also revoke any authorization to which I may or may not have agreed or signed for Red Cedar Services; www.500FastCash.com or any related affiliates to attach any part of my benefits or to contact Social Security Disability for collection purposes, effective immediately.

I demand that any future contact from Red Cedar Services; www.500FastCash.com or any affiliates be made through the US Postal Service or email only. I will need everything in writing to keep accurate records of all communication as per instruction from the New York State Attorney General's Office. All other forms of communication will be disregarded.

Moreover, I prohibit Red Cedar Services; www.500FastCash.com or any affiliates to contact any of my references listed on my loan application for the purposes of discussing my account or for any collections efforts.

Due to the fact that Internet payday loan lenders must be licensed in the state of New York to offer enforceable and legal and binding contracts,
your concerns should NOT issue loans to New York residents at all. I request that you send me, via US Postal Service or via email, a copy of license(s) which grant permission to any of your concerns to legally offer loans to residents of the state of New York.

Because such loans are illegal in the state of New York, I am only required to repay the principal of the loan. Therefore, I am willing to pay $300.00 USD only, which is the original amount of the loan. In each of the following months: January, 2012; February, 2012; March, 2012, and April, 2012, I have paid $90.00 USD in interest, for a total amount paid equal to $360.00 USD. That amount reflects an overpayment of $60.00 USD. At this time I request an immediate return email stating that my loan is paid in full. I also request immediate remittance to me from Red Cedar Services d/b/a www.500FastCash.com in the amount of $60.00 USD, the amount of the overpayment.

I am filing complaints against your firms with the Federal Trade Commission as well as the offices of the New York State and Oklahoma State Attorneys General.

I expect a response from either Red Cedar Services or www.500FastCash.com no later than 5 days from the above date regarding this matter. This response may only come via US Postal mail or email. No telephone contact is permitted.

Sincerely,

I just think you're giving them too much information. All you need to tell them is that you know they're an illegal lender in your state, you revoke ACH authorization and any voluntary wage assignments and that you paid X amount and either want a refund or will pay the remaining principal balance via whatever method you plan on paying them. What you have is just too wordy.

I agree as well. Way too wordy.

Try using one of these samples from my signature link.

Dear Lender,

It has come to my attention that payday loans are prohibited in my state. Therefore, the loan contract that I have with you, according to my state???s laws, is not enforceable. Although I am not required to do so, I am willing to repay the principal balance of the loan. To date, I have received $500 and have made 3 ???renewal??? payments of $120 leaving a balance due of $140. I am willing to repay the $140 balance via credit card in 2 monthly installments of $70 each on (insert date(s)).

At this time I am revoking ACH authorization. You are no longer authorized to withdraw payments from my checking account. I am also revoking any wage assignment I may have signed. I have given a copy of these revocations to both my bank and my employer. Any future attempts to collect funds in this manner will be blocked.

Please contact me to set up payment arrangements as outlined above.

Dear Lender,

It has come to my attention that payday lenders must be licensed by the state of (insert state) in order to offer loans to its residents. Since your company has no license in my state, the loan contract I have with you is not valid. Although I am not legally required to do so, I am willing to repay the principal balance of this loan. To date, I received a deposit of $500 on (insert date), and have had 6 bi-weekly withdrawals of $120 debited from my account. This results in an overpayment of $220.

At this time I am requesting a return email acknowledging that my loan has been paid in full. Also, I would like a refund of the $220 overpayment. A refund check of $220 should be mailed to me at the address you have on file.

I am also revoking authorization for ACH withdrawals and any wage assignment I may have signed. I have given a copy of these revocations to both my bank and my employer. Any future attempts to collect funds in this manner will be blocked.
Please respond to this email with acknowledgment that my account has been satisfied in full. Details of when I can expect the refund check, as discussed above, should also be included in the email.
