Push Back from Cash Call (Western Sky)

Cash Call (Western Sky) is claiming that they are legal and will report my miss payments on my credit record. I have offered a settlement to pay the principal back but they refuse. Do I have to notify the credit companies?


If they report to the credit bureaus, just dispute the trade line with them in writing clearly stating that the loan was originated by an illegal lender. Which state do you reside in?

Since Cash Call has originated with Western Sky, so they are illegal. You owe only the principal. No interest, no fees. Don’t worry, they can’t do anything.

Yes they will report on your credit reports. This is the only leverage they have to harass you into paying this illegal loan. There are several people on these boards, me included, that have disputed with the credit reporting agencies, but it comes back as a valid account. I am on my third round of disputes with both Experian and Equifax. They can't sue to get an enforceable judgment in state court so they use some loophole to report these illegal loans on your credit report in the hopes you will pay. We are all in the same boat.

One more question. Can I request my money back from Cash Call on a past payday loan. Is it even worth it?

Is report me to the credit bureaus? I still owe WS/CC 2100.38 in principal on this loan. I plan to pay that and then tell them to off themselves, which I expect them to come back with a fight saying I owe massive amounts more, blah, blah, blah. I haven't pulled the trigger on sending them my ACH revokations, etc...as I have done with other companies, because I wanted to get more of the principal paid before I pull the rug from under them and tell them they're not getting a dime over principal. Unfortunately I've had many other loans with them in which I over paid each time (unbeknownst to me, because I didn't know this forum existed then). I would like to figure all of those overpayments into this loan as well (since I've paid them so generously in the past on their illegal loans), but I am scared they will come back at me that much harder if I try that.

I'm curious to know though - for those of you who have already gone through this with WS/CC, will they come after me legally? Or will they just harass me until I pay them what they want? I will only agree to prinicpal, but will they ever agree with that? What is the end game? If it's just a dispute on my credit report, then bring it on. I could care less. My credit is already in the tank. I just want this nonsense out of my life.

Cash Call will not sue you (that I have been able to find after 8 months of researching) over a Western Sky Financial issued loan because to do so would automatically waive their claim of "immunity". They can't say that they are immune to the laws of the US and any state but then turn around and ask a state court for help to enforce their illegal loan agreements. Just make sure to not sign anything new that indicates you owe Cash Call - they will trick you into signing a remodification agreement or settlement where you agree that you owe Cash Call. Avoid this. Cash Call will do everything in their power to keep these cases out of courts and will lie and perjure themselves to do it.

file an FTC complaint against western sky/cashcall as they are going after them.then file another dispute stating that you have filed an FTC complaint,and will do the same with them if it is not removed.you must file the complaint with the FTC as that will get it removed.

Paul - if we file complaints against FTC against Experian and Equifax you mean??? For allowing an illegal tribal loan to be reported on our credit reports? Just wanted a little clarification as I have provided both Equifax and Experian with copies of my FTC complaints against Cash Call and Western Sky and they just keep sending it back as "verified and accurate".

yes file FTC complaints against the credit reporting agencies as since the FTC is taking action against this loan dodge they at least have to mark it "disputed'.let the FTC know this asap.that should change things.

I sent my ACH revocation last night after closing my account at the bank. This is the response I got:

Dear Customer,

Thank you for your correspondence. I have received your ACH cancellation request and it has been processed. The 05/10/13 draft is already pending on your account in the amount of $486.58, and was too late to stop by the time I received your request. However, I have updated your account and all future ACH transactions have been cancelled.

Your account has been placed in a cease and desist status. All communications from CashCall going forward will be communicated in writing through mail or email only. You will be receiving communication pertaining to legality of your loan.

This seemed a little revised from what everyone else was getting in their responses, or is it pretty much the same? I requested they don't contact my by phone - and told them calls to my employer would be recorded (as I work for a law enforcement agency).... I told them flat out the loan they were servicing was illegally originated, and they knew it (as well as were the two prior), and that I had overpaid on two prior loans with them to the tune to over a few thousand, so they could use that overpayment to towards the remaining principal balance, and then still send me a check for what remained....

as long as your account is secure they can try to debit,but only if your bank didn't secure the account will this go through.now was your loan originated through cashcall,or western sky?very important.
