Hello, I ended up taking out a payday loan to relieve some financial stress between jobs. I ended up in a cycle of getting new ones, just to pay off the other ones and now I'm behind. I live in Pennsylvania and I'm not too sure of the laws here. Here is a list of my creditors and amounts:

Great Plains: $400
My Cash Now: $400
Yellowdale: $200
US Fast Cash: $300

I need help to know how to get out of this vicious circle. I am in the process of trying to close my checking account to stop them from debiting them, but is it legal for me to do that? Any help would be greatly appreciated!!

Payday lending is illegal in the state of PA.

You need to first close your checking account to protect yourself. None of your lenders are licensed to lend in PA (since PDLs are illegal) and therefore are lending illegally.

Anything you've paid to them thus far in "fees" or "interest" should be subtracted from the principal loan amount. You should only repay the PRINCIPAL balance, and on your terms.

You can find sample illegal lender letters and further details on your next steps here.

Thank you so much! I am in the process of using the template to send them the letters/emails! Do you know if any of them are actually licensed at all?

As payday lending is prohibited in the state of Pennsylvania, so none of the payday lenders are licensed to operate in your state. You can get rid of the debts by paying them only the principal amount. If you have paid them more than the principal amount, then ask them for the refund. Illegal lenders won???t be able to take any legal action against you. If you want to get any information about those pdl companies, then you can contact with the Pennsylvania Department of Banking. The contact detail is as follows:
# Address - Market Square Plaza, 17 N. Second Street Harrisburg PA 17101
# Phone - (717) 214-8343
# Fax - (717) 787-8773

Paul- what did you mean "soveirgn nation"? Is that the same thing as tribal? Because I am dealing with the "tribal laws" here in Florida and no one can give me a straight answer.
I might have to hire an attorney if Western Sky wants me to pay them the principal plus their outrageous fees.
I have a thread posted with my case.
Thanks.

Tribal lenders are generally not licensed by any state....they consider themselves sovereign nation, operating under their own laws. In florida they have to be licensed. Check with

  • Regulator - Florida Office of Financial Regulation
  • Address - Division of Securities and Finance, 200 E. Gaines Street Tallahassee FL 32399
  • Phone - (850) 410-9805
  • Fax - (850) 410-9748

They will try to tell you they are not subject to florida laws....which is typical for illegal lenders.

Yes, sovereign nation is tribal.

Basically, because the reservation, although in the U.S. is technically it's own "sovereign nation" or it's own "country," our laws don't apply to them.

What they typcially forget, however, is that if they aren't bound by their laws, we are not bound by theirs either.

So even though these "Tribal/Sovereign Nation" lenders don't really apply themselves to US regulations, am I still able to tell them I am only going to pay the principal?

Thanks again for all the help! :D

despite their stupid assertions you only owe the principle, and they have no real legal recourse otherwise.

So just to be clear, I have been getting calls from a foreign sounding person saying that they are filing a lawsuit and they have my social security number with the government or something like that. They don't have any legal legs to stand on do they?
