So on Friday I sent the letter to OCC to tell them that I revoked authorization etc...etc.. and gave them the WA state laws and requested to be only contacted in writing and what do they do... they CALL me this morning with some message about how I have "other options" and to please call them. What other options? I have already re-paid the loan twice over in their fees and such so what other option do they think I want to take. At least I have proof that they received the letter... apparently didn't READ it as it states clearly to only contact by USPS or email... oh well the fun continues I guess.

No. They haven't and the account is closed. But I am not sending them anything else. They are illegal in the state of WA and are not licensed and I have paid them close to $700 for a $300 loan... so really there is nothing that needs to be "worked" out other then a refund which I am not holding my breath for.

Don't be too surprised, these companies didn't follow the law to begin with so they aren't about to begin doing the right thing by honoring your request not to contact you, other than via email. Also, FYI, a cease and desist doesn't apply legally to the original creditor, only a third party collector. The only reason why I personally demanded they cease and desist contact with me was because I figured it wouldn't hurt to try, most of the employees who work for illegal lenders aren't the brightest bulb in the bunch. lol However legally you can't really demand that the original creditor cease contact with you, the FDCPA doesn't apply to the original creditor.

Shoot. ;( Well at least I can still show that they received the ACH revocation! So even if they continue to call me and waste their time... that is all on them! I am sure that the "other" calls should start soon with the "we will take you to jail" and "The FBI is on their way to your house now" sort of threats that some others I know have had..... The FBI ones are my personal faves considering the FBI wouldn't work WITH those people but for us AGAINST them

hi bugman059,

i took out a payday loan with oneclickcash back in august 09, and paid back 225 in fees for a 250 dollar loan. i had problems with my checking account, and personal banker at my bank put a hard block on my account. i honored oneclickcash with my new checking account info and they would not accept it, so i could pay it in full. they said they could not accept my new account, because they needed a fax from my bank letter head, and signed by bank rep.. so my personal banker sent the fax of my new checking account, and still would not accept it. don't figure? they tried to ach my old account to no success and they emailed me telling me this, duh. now they want their money in full $430.00 and would i like them to call me? no. bank rep says tough. bank says don't worry and that they will not sue me and that i will not go to jail even though they have'nt threaten yet. as far as i am concerned, it is their fault they would not accept my new account. i consider that harrassment on their part. so now their saying i have to pay more, don't figure?

ps: any comments? sincerely, kim, veteran(USMC)
