Help with Cash Call/Western Sky

I'm in the same boat with WS/CC. I have yet to take any steps because I've heard conflicting info on this site whether or not they are legal.
Please, please, as soon as you can CLOSE your bank account. You should close your bank account before you send any letters to these lenders. You don't want them raiding it if they think you aren't going to pay.
I'm very curious as to what will happen if one does stop payment with them. I know WS is illegal lender but then again, most of their loans are installment loans not pdl's. My initial lender was WS but was immediately transferred to CC. Some of the posts here say CC is legal and backed by banks and will sue, others say they are illegal as well. I just don't know. I need more info before I make any decisions with this lender.

Western Sky is an illegal tribal lender and their operation is considered to be illegal in all 50 states. When you pick up a loan from WS, its an illegal loan. The loan contract is illegal just like everything else. So to sum it all up: WS loans are illegal loans.
CashCall by itself is not an illegal entity and any loans dealt out by CC is backed under a bank charter. Loans taken directly from CC are therefore LEGAL. Now, WS sells borrower accounts to CashCall within a few days of the borrower getting the money.
So the collection rights of an illegal loan backed by an illegal loan contract is handed over to a technically legal entity for collection.
Now what have we understood from the above diatribe:
CC has nothing more than the collection rights for illegal loans. The fact that CC is a legal entity has nothing to with the fact that the WS loan they are collecting on is illegal.
If the loan is illegal, it does not matter what ANYBODY says, you pay nothing more than the principal and you pay on your terms and time.

So, my original loan says Western Sky as the lender even though Cash Call has the loan now. I've paid over 1800 dollars over the principal. This means I should not pay them another cent? Do I follow the same steps as illegal PDL's even though it is an installment loan? I should close the bank account they draw from, then send them the letter telling them why? I really want to do this but I am really scared that they will find a way to sue me. Really conflicted here.

I took your advice about payday loans and I just received an email/letter from one yesterday that said they consider the debt paid in full! :D I am the original poster in this thread and since it worked, I registered with the site. I have a very long way to go and am nervous about dealing with Cash Call. Do I need to send a cease and desist letter via email or USPS?

I called my Attorney General's office and he said the loan is illegal pay the principal, ask for a debt validation letter, that shows the fee's and so on and if they don't reply he told me don't give them anything else. All I owe back is $325. I asked if they can sue, he said nope cause a judge would laugh at that. I asked for the letter and no response. I sent them multiple letter's, the first letter I got back is the same one they send everyone, sent it again and no response. They know what they are doing. If you have any question's call your Attorney General's Office, they guy I spoke to was cool and answered everything. Once I stated to Cash Call that I contacted the Attorney General, I have not heard a word back. Good Luck and keep fighting;)
