My orginal loan was with Sagmore for 300.00 which i have paid more than that in refinance charges. I tried to get them to take all my refinance payments and put them towards the loan amount when my hours were cut a work but they would not so i closed my bank account so they would stop withdrawing that amount each pay period. My loan has now been turned over to I-Collect. I received a call from a man stating that i now owed over 800.00 in fees and that he works with the collin county court system and that i need to set up a payment arrangement. He also asked if i had ever been taking to court for check fraud or a returned check. I did not ever write them a personal check so i wasn't sure how they could get me on that. I keep telling him to e-mail me something in writing about his company and the arrangements. Right after i talked to him my bank closed out that debt card because there had been fraud on the card and that was the card that was used to set up the arrangements. I got a call from him saying it didn't go thru and he needed a different number. I did leave him a message saying i had never received anything from him about his company and our agreement. well finally i did receive something but i have not set up new arrangements yet. In the state of texas what can they do to me.

By the way, the next time Icollect calls you, tell them they now have 5 days from their first initial contact with you to send you a dunning letter (letter of collection) via the mail, they should already know this but tell them that is a federal law (FDCPA Fair Debt Collection Practices Act), also let them know you will NOT acknowledge or deny this debt until you receive a letter of collection thru the mail and they are NOT to contact you again until you receive this letter. If they do call you after you have requested a letter of collection, file a complaint with detailed information with the FTC (link in my signature). IF and when you receive a letter of collection, you will have a 30 day window to dispute it (per the FDCPA), at that time you should send them a debt validation letter ( look up a sample letter on this site). Make sure you send out that debt validation as soon as you receive the letter of collection, do NOT wait, do it right away! Send it certified mail return receipt requested, keep a copy of the letter and the green card they will need to sign to accept the debt validation letter. KEEP ALL correspondence, keep a journal of EVERY phone call they make, ask the name of the person calling, ask for the employee ID number, keep track of the time and date of the call and the phone number that called you. KEEP RECORDS of EVERYthing!
