Proving Fraud

We have received a claim by a debt collection company Check Solutions of America for an online payday loan that we supposedly made through Sandpoint Capital LLC. Sandpoint is claiming that we took out a loan it was deposited into my account and then I closed the account before they could collect their payment back.
I NEVER took out a payday loan through them or ever! Also I have only had one checking account in my entire life and and there hasn't been any of the activity they are claiming on it. I can't find any contact info on Sandpoint to get the original loan, to see what bank account is was connected and the debt collection company is saying they don't have it. They have further info but they won't release it unless we progress legally. They are pressuring us to settle but I don't want to pay for something I didn't do. I'm not being given a chance to prove my innocence!
Do I just have to take this?

Thank you your response!

We received a letter some time ago but checked into the company and thought it was a scam so we didn't respond. Now it turns out they are legit and they called us and our grandmother saying she was next of kin (which she isn't)

They said they have information like which bank account the original claim was attached to but wouldn't release that information unless we chose to fight them legally.

Oh wow, a letter in the mail, not good news. According to the FDCPA you have 30 days to dispute a letter of collection, do you think it's past the 30 days?

We are in CA. So how do we disprove this? Can we tell them to take a flying leap? How do we back ourselves up legally. We are definitely outside the 30 days from the letter.

I need to research something regarding Sandpoint, if they aren't licensed in your state, then you can just tell this collection agency to go take a flying leap because the payday lender isn't licensed to lend in Ca, which means the loan wouldn't have been legal to begin with. I realize of course that you never borrowed any money, I am just trying to give you a simpler way of getting rid of them! Hang tight!

Just as I suspected, they aren't even legal in your state!! I would file complaints against this Check Solutions of America with the FTC, BBB and your attorney general's office, make sure it's a detailed report with as much information as you have about them, their location, phone number, EVERYthing, also make sure you specify all communications between them and you, when they called, the number they called from and what they said to you. You can do this online, make sure you print out your complaints, then the next time they call you, tell them what you have done, and also inform them you NEVER obtained a payday loan and even if you had the company they are representing is NOT LEGAL in California, so they can go piss up a rope as far as your concerned. lol

really?and what info suggested this piece of sh*t bottomfeeder is legit.for one thing threatening fraud is against the law as debt are civil matters.second thing is file AG complaints against this bunch of humanoids as they won't take you to court as they would have to serve you,and they wouldn't have a prayer.thirdly they don't hav squat for info.they are just trying to scare you into paying.btw i checked my state IL,and this peice of sh*t collector isn't licensed in my state.so i doubt they are licensed period.fight these losers as best you can.first file a police report as the fraud accusation qualifies as a threat.then file AG,and FTC complaints against the scuzzbucket collector.btw sandpoint is not even located in this country and illegal.so whoever tries to collect for them is more than likely a bunch of losers who wouldn't know the law if i wrote in on a shovel and beat them with it.file the complaints, the police report then ignore their sorry a$$E$.they can't do a thing they threaten.

I can not thank you enough. Where can I look up Sandpoints legal status so I can obtain a copy of it for my records? Thank you! Thank you! Thank you!

Great News everyone! I called my State Attorney General's office and not only does Sandpoint not have a license to operate in CA but on-line payday loans are illegal in the state! I get to tell them where to jump! Thank you for all of your help, I never would have know where to start otherwise!
