I live in NY and now realize these are illegal correct? So far I have taken the following steps:
Closed my checking account associated with all of these PDLs
Contacted the Attorney General and they said they will be sending me a form to fill out for all of these PDL companies
I also called Cash Taxi (whose PDL I paid off in full last week) and told them that since I live in NY the loan was illegal. The woman on the phone told me that since THEY do not operate within NY then it is a legal, binding loan.
I was just wondering if I am doing things correctly, what to do next, do I even need to pay the principal on any/all of these or I do I owe nothing to any of them (possible refunds of what I have already paid?)
Thank you for any help/advice!
Plaingreen Response to Demand Letter
Hi,
I have been reading these posts and recently got myself out of $18,000 worth of payday loans I accrued last year. What a nightmare! (I live in CA) But I had no idea I could go back and try to re-claim the interest due to the companies not being licensed in CA. The first one I tried was with Plaingreen. This was their response to me:
Your correspondence has been directed to me for review.
We are sorry you are not satisfied with your Plain Green Loan. At this time we have closed your account from further activity.
To further clarity your questions regarding the legality of this loan, Plain Green is organized under the laws of the Chippewa-Cree Tribe of the Rocky Boy’s Indian Reservation of Montana (“Chippewa-Cree”). Plain Green is owned by the Chippewa-Cree, and operates exclusively on land owned by the Chippewa-Cree. As such, Plain Green stands as an “Arm of the Tribe,” in the view of the United States state and federal courts. Therefore, loans made by an arm of a sovereign Indian nation are not subject to state law. This is NOT a payday loan.
This letter is written to help you understand that Plain Green and its loan contracts are governed exclusively by the laws of the Chippewa-Cree.
Pursuant to your request, we have removed your contact numbers from our system and we will make no further ACH debits from your account.
Thank you again for your time and consideration.
I still have the following to tackle:
-United Cash Loans
-Eastside Lenders
-Elite Cash Services
-First American Credit
-VIP Loan Shop
-Gentlebreeze
-Cash In A Wink
-Excel
-Fast Cash Time
-Springleaf
-Classic Group
-Wilshire Financial
-Quick Click Loans
I'm not really pleased with the results of Plaingreen. Do you have anything I could add, or something I could say via phone call, to my future letters/conversations that may get me my money back?? Plaingreen did not refer to themselves as a payday loan comapny, and that's how they are attempting to weasel out of this. Well, that and the Indian Reservation bs.
Thanks!
I dont see any lender on the
I dont see any lender on the list that is going to give you a refund....none are licensed anywhere in the US.
