A lawyer company by the name of William Prescott called and said I owed a company by the name of Payday Yes and this was from 2009. I have never received anything in the mail about this and he said they send everything by email they sent it to my previous work e-mail they said It is Nov of 2012 and they are saying they are sending a police man out tomorrow ith papers to sue me for the amount of over $3000 and the amount they said I borrowed was $900 Can they sue me and why haven't I been contacted before now? I do not believe I owe this money My question again is can they actually send someone to my work to serve me papers at work????


The person who called you is from a company that has been a topic on this board in several threads. Since they stated that they sent an e-mail to your old work I question the legitimacy of any debt they say that you owe. Anyone who has a legitimate debt will not bother to tell you that they are going to serve you, they just will. This company (I think it is CRS and associates) will use threats and harassment to attempt to strong arm you into paying an illegal debt or on something that was paid off long ago.

There is a thread entitled CRS that will have more information about what is happening to you and how to deal with it.

If you can get an address for this company, send a C&D letter. You should also file a complaint against them with the FTC as any debt you may "owe" is illegal.

FYI - CMRRR is certified mail, return receipt requested. A lot of illegal lenders use dropboxes and fake addresses to keep operating. Chances are if you have a physical address it probably doesn't get checked often enough to matter so be sure you email and/or fax your letters as well so you have some further traceability in your communications with them. People claiming to be process servers or that they are sending process servers are full of it. They want you scared and willing to pay more than you owe.
