Date: Mon, 05/10/2010 - 13:02
I live in NY,
I have Payday Loans with
-Ace Cash services $250 (alomst paid)
-Shamrock Marketing $300 (partly paid)
-PDlnow.com $200 (paying just interest)
-paychextoday.com $300 (have not paid)
-gr enterprises $250 (1 interest payment)
-payday loan.com $350 (have not paid)
-national payday loan.com $300(have not paid)
I also have about three credit cards in collections (none of which I started to make settlements or payments)
I had some rough times in the past and got myself into trouble, Im not blaming anyone but myself, This is a trap I will NEVER get in again. (that might be the hardest part!)
This is a lot of debit to me, i do not make that much, and withese these payments at least 2 or 3 comnig out of my $400 check a week i am getting killed with fees.
I Was looking for a reputable company that will handle both the collection credit cards and pdl's. I have tried to contact some of these and honestly my biggest thing is trying to get one monthly payment, my paychecks are switching to were i may get paid once monthly or bi-weekly and i just need to have one date to pay these all back. I have seen the site OvgL (i thinik) listed here as a debt consolidation, does anyone have any reviews on how they are?
Any help is VERY MUCH appreciated! I will try to offer anyhelp I can to what i know to others in need as I think this is a great site! Thanks again!

Hi, JK. Welcome to the forum. First of all, it's likely you can get a handle on this yourself and save the fees that will be charged by a consolidation company.
Internet PDLs are not legal in the state of NY at all. Were these all Internet PDLs?
Please tell me exactly how much you've paid on these loans. I don't care what they say you've paid toward the pricipal. I want to know how much has been debited from your account for each and every loan.
You're going to have to close your checking account and open a new one, but we'll get to that after we figure out how many of these suckers are already paid off, how many owe YOU money, and how much you REALLY owe, if anything.
Once we get you owning your paycheck again, we can deal with the credit cards.

Honestly, I wouldn't even consider debt consolidation for unlicensed payday lenders, they can't sue you because they aren't licensed, they will threaten you but the bottom line is; there isn't anything they can legally do to you over the payday loans. Close your account and read the link I gave above on how to deal with them.
As far as the credit cards, are you in default with any of them? How far behind are you?

Shazzers, thanks for the info, I read over it and it is good to here I think that they can't go after me. I just want to take care of all these I dont really want calls at work, or them to call my references as well.

Shamrock - $300.
PDLNow.com- $156
Paychextoday - $90
Vince enterprises - $90 (im not sure which one this is for?) one of the $300 ones i believe.
I have dates of all the withdrawls as well.
I have closed out my bank account, Two of the payments are set to come out from this paycheck, so any info on where i should go from here is appreciated!

Just email the letters, read the thread on how to deal with unlicensed lenders. Make sure you revoke their right to ACH your account at the bank. If your account is closed it can't be forced back open if you revoke the ACH's with the bank.
Here you are. Ace cash - $475 (you've overpaid them by $225.
Here you are.
Ace cash - $475 (you've overpaid them by $225. They owe YOU).
Shamrock - $300 (you don't owe them anything)
PDLNow.com- $156 (you owe only $44)
Paychextoday - $90 (you owe $210)
Vince enterprises - $90 (im not sure which one this is for?) one of the $300 ones i believe (then, you owe $210)
Go to the link Shazz mentioned and get your letters drafted using the $ amounts above that you owe or are owed. Make sure to revoke ACH and wage assignment in writing with each company, with your HR department at work for wage assignment, and with your bank for the ACH revocations.
You'll own your paycheck again in no time.

Ok, thanks shazzers and ohiogal1!
jsut a couple questions, what if they still try to get more $$ from me in interest payments? What is wage assignment? can they still try to garnish my wages at work?

Well, they likely WILL try to collect more from you. You just have to be persistent and stick to your guns. The law is on your side. You have to keep in mind that these people are illegal lenders. They prey on people who are in trouble and have nowhere to turn.
Regarding wage assignment, some of these PDLs have you sign a voluntary wage assignment along with your loan "papers." The key word here is "voluntary." You can revoke it at any time. Generally, it's just a safe bet to provide your HR department with a copy of your letter revoking the assignment.

Ok I will do that as far as with my employer, Its starting to become a headache already though. I was trying to be proactive but I just received two calls at my work, about the loans on my voicemail. Should I call them back or just email the letters today? I went over the letters so I know what to do, but I really dont want to have the calls keep coming to my work. The one company national payday loan, left me a message threatning wage garnishment just now, so pretty much should I call? Just send the letters? Need some help Please! Thanks!!

Send the letters. The more you talk on the phone with them, the more they'll call. Send the letters and KEEP sending them until you get a response. Make sure you file your complaints with the AG, BBB and FTC as well. They can't garnish you without a court order. Your wage assignment is voluntary. Revoke it!
