Payay loan collection practies smith,dean and associates

i told her that she owed them 150.00, not 400.00 if she had already paid 100.00, i feel really bad, beause that was all the money she had till payday which a week or two away. but she was so scared they were going to arrest her

You can't be arrested for not paying a payday loan. She only owes the $150 and she owes that to the original lender only. If they've sold the account to a CA, it's uncollectable as they won't be able to verify the debt, since it was illegal to begin with.

Has your friend paid $400 to that CA? If that is the case, then don't expect to get that back. The CA has just used scare tactics to get the money. Has your friend closed the account? If not, she must do so as soon as possible. And as OhioGal posted, she owes $150 to the original creditor, not to any CA.

Tell your friend to NEVER admit to owing a debt to a voice on the phone, if they are truly a legit collection firm they will send her a letter of collection via the mail, though I doubt they are since payday loans are prohibited in her state.

yes she paid 426.00 thats what the ca rep told her she had to pay otherwise they were coming to pick her up and take her to jail for fraud , told her she would have to sit in jail till she paid, I told her to file with the ftc, bbb and at general. I have found alot of info on the collection agency that called her and they are extemely bad, i looked them up on bbb and they had a rating of an F and they have banned in some states from collecting.

@debt samaration, she wired the money to them via quick collect one of those types of things.

You gave your friend great advice, and I hope she follows it. This is what collectors like these bottom feeders want: to keep people scared and ignorant of their rights. This is one reason while sites like ours are so important.
Hopefully one of these agencies will be able to get her money back for her.

I know I owe them i've paid back on time before but i got sick so i told them i go back to work the 24th of this month. now this lady call me name tracy barker and told me they are going to arrest me for a worthless check its a felony and i have until 4pm today to pay. i got on line and found out they are a collection company and they telling me they are a lawyer what can i do. i want have the funds until the 24th.
