I received this e-mail yesterday and not sure what to do.

Call or e-mail me regarding your defaulted loan. Our Legal dept is filing a Civil Judgment against you in County Court for Fraud. We have tried several times to contact you and all correspondence was ignored. A great offer was made to settle this with monthly payments until it was paid in full, and that too was ignored. It became very clear to this Firm that you had no intentions of ever repaying this loan.

The offer is still on the table until the filing, if I can help you in any way please contact me and reference

I'm in NY, i took out several payday loans and after i found this website i sent cease and decease e-mails to all of them. I also change my phone number and i filed complains with FTC, BBB, Attorney General and a couple of other agencies. The only company that kept harrasing me was pay day loan yes, threatening me to call my supervisor and stuff like that.

One of my references received two calls from a Frank Johnson and he left me a message at work, saying that a complain was made against my SS# and leaving the last 4 digits. The guy had a very heavy indian accent and i could hardly understand his message. I never called him back. I'm not sure what to do with this e-mail. They have a website but no physical address and there is no info on them at the BBB website. What should i do.. Thanks in advance for your help


btw they contradict themselves as if they already filed why would they have it posted that"the offer is still on the table until the filing"i swear when idiots try to use scare tactics either through the phone or email it is so stupid.do as shazzers advised and check NY state law in regards to recording calls,or being able to play messages for your AG as i'm sure they will call and threaten illegaly and stupidly as well.

Hello, in regards to the email we sent you. There is nothing illegal about it. We are offering to work with you and if not, because your in NY with us we will simply file for small claims court. You can record us if you want, but we dont threaten people, feel free to research our number and you will find no complaints.
If you would like to work out a plan we willl be happy to work with you, we can go as low as $50.00 for most hardship cases.
Otherwise, its just a judgment. You wont go to jail, we dont stalk people at work, etc..BTW we are small and the company the indian fellow called from was not is.

Paul,
They are not legal to lend in NY, there is nothing stopping people from using them from out of state providers.
Also, I have the benefit of an attorney on retainer, and I will take his word over yours that I can get a judgment in a county where I have a presence, i.e. Erie.
Regarding your claim nothing legit is done over email. It is our experience that email is the least invasive method of contacting clients aside from the normal postal service mail. No need to be rude.
To the OP, not every agency is a bad one. Granted 90% are, there are the small 10% that aren't.

again pdl's of any kind are illegal in NY especially internet.good for you and your ambulance chasing lawyer.in a NY court regarding pdl's you would have the same chance as ice in august and the email was an illegal threat.btw you have 30 days from that in accordance with the FDCPA to file suit or get sued yourself.let's see your spin on that.

OK. Will not argue, simply agree to disagree. Assuming we do not work out something with the OP then it would be up to him to share information regarding the filing, as we do not disclose private information on public forums.
Just out of curiosity, if these loans are illegal, then wouldn't it be illegal for the borrower to receive them in the first place? Sounds like two wrongs don't make it right. Don't get me wrong, they are bad, I took one out a few years ago to get an idea of what I was collecting and its not a good deal.

Agreed, I do not deny it is predatory. With regards to ignoring you, I am not. But no matter what I say you will just take the opposite stance, so again, I just agree to disagree.
Unlike other "bottom feeders", I actually search my name/number everyday to see if anyone has lodged a complaint and to at least follow up with it to them.
I am a registered business and although it is nearly impossible to do so in this industry, I try to keep the name clean.
I am probably in the wrong industry lol...

again i encourage the OP to keep track of when that "rock stupid" email was sent as it contained enough double speak to get you sued right now,but if you do not file suit in 30 DAYS as i've stated before you just broke the law mister.so please stop it.nobody here believes what you post,and you look like an absolute fool.last thing i googled,and yahooed spotlight resolutions and i'll give you one guess as to what the very first thing that came up on both was.this very thread.so here's hoping your sued and real soon pal.

Exactly, this is the only thing that came up.
You strike me as the type of fellow who has a lot of liens and filings of their own against them.
Either way, regardless of whether his fellow wanted to settle or now, you have called me out and I have to file now. He can thank you, I could care less.
