Hi,

I'm new to these forums. Stumbled through when I was googling help with payday loans. I live in Texas,a nd have numerous payday loans. I don't know what to do. I've gotten way over my head, and now I'm past due on my car payment and my rent is due on the 1st. I have all these loans that are supposed to come out to, and I will not have enough for everything. Here's my loans:
Check N Go Installment(1st Bank of Deleware) $1400.00, have made one payment of 303.33
Payday One (Online)
$320.00 due, original loan $400.00
Payday OK (Online)
$350.00 due, original loan $500.00
Cash Central (Online)
$300.00
East Side Lenders (Online)
$300.00
Little Loan Shoppe (Online)
$250.00
BIG Ltd. (phone)
$200.00
Loan Shop/DKS
$300.00

Hi THolland. Welcome to the forum. :-) I am a little confused as to how you got the Big Ltd. loan and the Loan Shop loan. For Big Ltd., you have "phone" beside it. Did you sign any sort of ppwk for the loan? Also, for Loan Shop, it doesn't say how you acquired the loan. I'm pretty sure that none of the online pdls are licensed in your state, but you can do a search here and find out. Also, the checkngo installment loan is, unfortunately, 100% legal and backed by an FDIC insured bank. I have a friend who is dealing with them. She defaulted about a month or so ago. For the most part, they have been pretty decent, but they will not accept partial payments. It is all or nothing. She is hoping that they will turn it over to a collection agency so that she can make reasonable payment arrangements.

Payday One, Payday OK, and Cash Central are all operating as CSO's in Texas. A CSO means Credit Service Organization. This means that the pdl laws don't apply to them.

In essence, a CSO or Credit Services Organization is defined by the Texas Credit Services Organization Act (Section 393 of the Texas Finance Code) as an entity or person that provides one of the following services:

*Improving a consumer's credit history or rating
*Obtaining an extension of consumer credit for the consumer
*Providing advice or assistance to a consumer regarding the previous two services

An important aspect of the CSO or Credit Services Organization model is that there IS NO LICENSING required by the state! CSO's are required to "Register" with the Secretary of State, they are NOT licensed, and their fees ARE NOT REGULATED.

I closed my account Thursday. I spoke with the branch manager and she assured me it would be closed. I'm looking into working with Town & Country to get these resolved, but won't be able to pay them until the 15th. I just checked my email and have my first email from Payday OK, asking me to contact them regarding my account. My questions is should I send them letters still, or just let Town & Country deal with them?

You're welcome for the checkngo info, tholland. :-) I don't see why it would hurt to send the cease and desist letter since you are going to do a consolidation or settlement. They will need to do all of their communication with T&C anyway. It doesn't sound like Big ltd. would be legal since they are in London, the transaction was made via verbal agreement on the phone, AND there was no ppwk. I wonder if T&C would know about that?
