How to stop CashCall! Are they legal in Louisiana?
Date: Sun, 05/27/2012 - 15:54
My husband got a loan with Western Sky and sold it a day later to Cash Call! Anyway, Cash Call keeps calling. I now have them blocked on my cell! I told them to stop calling before blocking them, but everyday they call!!
1) How do we get out of this mess?
We needed the money to pay our rent! My husband was sick and missed some work, so we truly needed help! Now I feel like we are stuck in a never ending story! $1500 loan which WS kept $500 and we get to pay back $4752 ($198 a month) for 2 yrs! Our first payment of $62 is due June 1st! I'm not giving them any info on us! I don't want my husband sued, I don't want us to go to go to court either!
2) How is any of this legal?
3)How do we prevent this from ruing my husbands credit completely? I don't want this to bring my husbands credit any lower than it already is!
4) The lady at http://www.ofi.state.la.us/ (225) 925-4660 said that these loans are LEGAL! I read the BBB and they say the FTC brought suit against them, is Cash Call there way around that?!
Thanks for all help. Please answer all 4 questions. Thanks!

Your husband only has to pay back the principal amount. They won't be able to sue you if they are illegal in your state.
1. Morally, you only owe these bloodsuckers the principal amount
1. Morally, you only owe these bloodsuckers the principal amount that you had borrowed off of them. Technically, you don't owe them anything because they are illegal. Legally, they can't sue you over an illegal loan. Even if CashCall is a legal entity, the loan was originated by Western Sky which is an illegal tribal lender.
2. It is not legal, in any and every sense of the term. In case you are referring to WS selling the debt to CC, such things happen all the time.
3. I don't think they will be reporting the account to the credit bureaus. Check your credit report once just in case.
4. CashCall has not found a way around getting sued by the FTC. They just keep at regardless of the charges against them.
Both Western Sky and Cash Call are illegal. Your husband is liab
Both Western Sky and Cash Call are illegal. Your husband is liable only for the principal. No need to pay any interest or fees. Ask them for the refund, if you have overpaid them. Look at this page to know about how to deal with illegal lenders:

illegal lenders
Neither is 500fast cash or oneclickcash. 500fastcash is also tribally owned and operates out of Nebraska. The Nebraska attorney general took them to court and ordered them to cease. They are still going. I took out a $550 loan--the max in my state is $350--and I have paid them to date $1585. I called the office of financial institutions and talked to the director and he said I am liable for the loan even though I have paid them over $1000 in interest. Our states and am sure most states do not regulate internet loans. So why are we paying these politicians if they are doing nothing to help us?:(
illegal lenders
sewsewgrandma,
That's the same thing the The lady at http://www.ofi.state.la.us/ (225) 925-4660 said! These loans are LEGAL! They do not need a license and they do not need to be regulated!
I'm wondering why these politicians do NOT want to help their citizens!
This site says they are illegal loans, yet the state people say they are and there's nothing you can do about it! WHO do you believe?!

legal or not
Legal? Not Legal? Not one politician or lawyer will touch this. I even spoke to the Attorney General's office and was given the same bull. They do not need to be licensed here, on in the state they are out of and have to follow that states rules. They are in one state, licensed in another state, and claiming they are licensed here and are not.
I have even been on the phone with more than one attorney. They only will file bankruptcy and won't touch a payday loan and told me this basically in so many words.
I do know that 500fast cash and oneclickcash are tribally owned. It states so on their documents so I am revoking ACH on them and stating I have overpaid them and stating how much. If they want to bring me to court, so be. I have proof of what was borrowed and what has been paid back.
I need my life back. With over $100,000 in medical bills, we just lost a grandbaby an hour after birth, and all the stress, I went into a deep depression these past 3 months. I seriously thought of suicide many times. My son's girlfriend would come in and I would be crying non-stop. I have to do something to gain control and this is it. I will not let these bloodsucking companies ever get me to that point again. If they want to sue, let's go to court. When I bring paperwork and bills totaling $100,000 before the judge, I will ask him what am I supposed to do? I have to be able to pay some utilities, buy groceries, etc. I have already had a lot of little luxuries, like cable, cut off and was even thinking I would have to sell my car. But it is going to be okay. I refuse to think otherwise.
Hope everything works out for you. Please keep me updated and I will do the same. We have to stick together. I am also thinking about writing the governor, senators, and reps.. Do not know whether it will do any good or even if they will read it but someone needs to inform these people as to what is going on here. These companies need to be regulated somehow. They are circumventing the laws by licensing in a state they know will let them get away basically with murder in the financial form. This just isn't right. Sometimes things happen. We get in over our heads when dealing with stressful situations even though we know we shouldn't and there should be someone that says you can't do that. Louisiana law clearly states you can only borrow up to $350 and these companies are loaning way over that. Louisiana states that you cannot rollover. You can pay the interest and a percentage on the principal and enter into a new loan. I have been paying principal only on these loans for quite a while--the tribal ones for almost a year now.
Cash Call
I am not quit sure why Western Sky/Cash Call can get away with what they do but it makes you think that maybe they have some kind of connection with the Govt. , like lobbyists or something (just an opinion) but I really have this feeling that something is going to happen. I heard that some states are banning together to sue this bunch, but don't know exactly what is happening. Like I said in a previous post that they do not offer loans to some of the states (ones that have sued them) so they aren't totally out of reach. I guess it depends on what states want to take on these bunch of thieve. I will say that the PA Department of Banking has been of great help to me regarding my Payday loans and do sue companies that the residents of PA complain about. Haven't heard anything about Western Sky though. Maybe I should ask them?
Journalist working to expose CashCash 'Scam'
Hi there,
My name is Joe O'Connor. I write for the National Post newspaper in Toronto and I am doing a story on J. Paul Reddam, the CashCall king, and a Canadian ??? and the owner of Triple Crown threat I'll Have Another.
I am looking for CashCall clients to come forward and tell their story. CashCall, for now, is a legal identity, but under investigation by several state regulators.
If you have dealings with them please and would like to share your story please contact me at (deleted) or call (deleted)
Thanks,
Joe
