Can a payday loan co take you to court for non payment in ky

I took out a payday loan in ky in 2007. I had every intention of repaying it but things happen. I closed my account several months later. They continued to call me but stopped after time. About once a year I get a call from another company on their behalf. I have been told that if I don't repay the loan that they will have a sherriff out to arrest me. This has never happened. Another company called yesterday, the lady said that if I don't pay at least $250 that she will have civil and criminal charges filed against me. She said the civil part would be them garnishing my wages and the criminal part would be check fraud and I would serve jail time. I looked up the laws in ky and it states that noone can be prosecuted for writing a bad check to a pay day loan institute. But my question is does that apply in this instance since it was 2007 that the loan was taken out. The law wasn't passed until 2010 that states that you cannot be prosecuted. I just want to doublecheck because I would hate to have a sherriff actually show up at my door. thanks
