I realize they are an illegal lender and I only have 2 more payments on them and cannot close my account right now it is tied to many different things including a modification that I am about to close on my home, I cannot close the account as per my attorney since I am also in the middle of closing my BK. I know its a huge mess brought on by loosing my job an almost looking my house due to Countrywides big messup a few years ago. Anyways....

I got a call yesterday from Target Cash letting me know that they had not been able to withdrawal out last payment because they where having technical difficulties and wanted a debit card. Said they would give me a discount if I gave them a debit card. I am not stupid and will not give them a debit card. I told them its not my fault they have technical difficulties but they have called a few times already.

What is going on with them, I read on another post here that someone else is having the same problem with a different company.

from what i got helpinaz they overpaid the principle, and that should be noted to their lawyer,or the BK trustee.

Could be - could be they lied and trying to get you to pay off early - I wouldn't worry about it at all.. You were only responsible for principal with them to begin with how much did you originally borrow and how much paid to date? You may be asking for a PIF and refund when you send them your ACH Revoke!

i don't think this illegal is part of his BK so that is a moot point.however since this is an illegal lender that charges obscene int,and the fact that you only owe the principle no int,or fees i'm almost sure you paid this so do as helpinaz suggested with ACH revocation, and don't give them another thought.

Actually even if they are not included on your original BK paper work - it doesn't matter - they are still included either way - due to the fact that they debt was incurred prior to the filing of the BK - I would do exactly as momofthree advises. You can not choose what debt to include and what not to.

Oh and the notice that post have been made to threads is being looked at it worked for day or so and then not again.

You have done the right thing by not giving them your debit card. Don’t share any personal information with them and tell your bank to revoke ACH authorization. Don’t pay them an extra dime other than the principal balance. If required, file a complaint against them to the SAG or FTC.

I wonder if the technical difficulties are due to the hacking issues that Target had over the holidays? Even so, that's not your problem and continue to tell them that.

@kscornell - Target Cash is a illegal tribal lender... no way associated with Target stores so I am pretty sure no related in any way!!!

@davidperezThe technical difficulty is more than likely due to banks blocking these transactions on many levels. again still not your problem, Is there any way with all that is going on you can put your account on deposit only? you can still send them a revoking letter for ACH! But, also if you are in the middle of your BK - they should have been on it as well and should not be calling you at all!

Thanks all, sorry I didn't respond sooner I was not alerted that anyone had responded. No this has no relation to the Target store breach. Target Cash is an online tribal lender and I know they are illegal. Because they are an online lender I was told it cannot be put into the BK and was told to finish paying them as soon as I could just to get them off my back. Like I said I only have 2 more payments and yes I have way overpaid. I cannot put my account on deposit only, I have my mortgage taken out by a Trustee and a few other payments taken out automatically as per the BK.

I will continue with revoking the ACH withdrawals but I would like to understand what is going on. Was there something that happened which caused banks to stop allowing the ACH withdrawals? I have not found anything online about this.

Thanks all, I went ahead an contacted my lawyer and he will be adding it per my request. I also went to the bank and cancelled the ACH privilages. I will sending a letter to Target Cash tomorrow. I still don't know what is going on and why they are no longer able to do the ACH withdrawal if it is my bank doing it or a nationwide thing. Does anyone know?

Paul is right - this is dischargeable under your bankruptcy and your attorney is committing malpractice if he does not include this. You need to amend your schedules ASAP to list this debt and any others that you have left off. You must "include" or list every debt that you have if you file bankruptcy. You will be required to sign a document under penalty of perjury verifying that all of your debts are listed. For this attorney to knowingly not include this debt is putting you in jeopardy of committing perjury, especially in a Chapter 11 and 13 BK -- you are not to make any payments that the Trustee has not approved. You are only hurting yourself for not fighting for your rights. I would immediately contact the Trustee's office to notify them that you left out a creditor and need to amend the schedules however your attorney is refusing to do so. You are really doing yourself an injustice and potentially tanking your case for not disclosing all information to the Court and Trustee. Under Chapter 11 and 13 they give priority to certain creditors and your Trustee payment goes to pay a percentage based on priority of creditor -- you are undermining the entire system and giving priority to a creditor by continuing to make the payments for an undisclosed debt. What state are you in and what district is your BK filed in? I will search to see if Target Finance, LLC has filed proofs of claims in any other cases so you can show your attorney.

i would give the ACH revocations to your bank, but the topic is on the forums.now if your lawyer told you that you cannot put a tribal pdl in a BK then they lied,or are stupid.either way do not give this illegal another cent.again give the revocation letter to a bank manager and don't pay them another cent.you are owed by them, but since they are tribal they will claim you still owe.too bad for them.

Thanks Paul, I understand about my laywer being a liar. Most of them are and I am sure he just didn't want to deal with it. What do you mean about the topic being on the forum? Is there a discussion about the banks not allowing ACH from payday lenders anymore?
