Once again I have gotten myself in a financial bind. Has anyone ever bounced a check thru telecheck? I bounced a check that Telecheck is trying to collect on. I am afraid of going to jail!! :( Someone has been calling from investigations, which is an office within telecheck. I made a partial payment on this check. Will they prosecute me?


No you won't go to jail. Just keep in touch with them and tell them you will make good on the check and keep your word. To go to jail they would have to press criminal charges. For what? You did not commit fraud. Fraud is a deliberate act. Also, if you were in jail they could not collect your money. Debtors prison went out 200 years ago.

Thank you frogpatch! I have been avoiding their call when I see the number on caller ID. I haven't been able to keep my word :( and the payments have been smaller than what we agreed upon. Guess I need to bite the bullet and call them. I tried to get a loan thru Cash Call and got turned down which after reading postings on this site about that company, I am better off!

I have a question. You can't go to jail for one bad check? I had a friend (this was quite a few years ago) who was arrested and held in jail for a "bad check". This person was never contacted by the store (it was a grocery store) regarding the check coming back bounced. Next thing you know, my friend had a police office with a warrant at the door. Went to jail for "theft by deception". She had to pay it (wasn't even aware of it!), pay court costs, and also shows on her "criminal record". That was for one bad check.

If you write a bad check and don't take care of it, eventually they will take you to court. If the check is over a certain amount (whatever it is in your state)it could be a felony and if you don't make an effort to pay I think they could arrest you. Please don't dodge calls from telecheck. Call them and be honest and make payment arrangements and stick with them.

In regards to your friend that got busted for the check, its because it was a check that was in exchange for "Goods & Services" at the immediate time the check was issued (Grocery Store). Thats fraud. If the account was already closed or he knew there was no money there, is fraud. A loan payment check that bounces for NSF is not fraud. Bounced Postdated checks are not considered fraud in any way.

Yes, that self-imposed jail of worry, fear and frustration. Depending on where you live, you can as the person above mentioned go be charged with a felony if you knowingly write checks on a closed account, or over a certain limit or on an (out-of-state) check for any amount (Washington state rules).
