Can you tell me if these PDL's are legal?

Geneva Roth or Loan Point
Loanshop
Plaza Processing
CashTransferCenter or Northway
Big LTD

I am drowning and want to get out. Any suggestions.

Well I know that Geneva is not legal, and Big is not even in this country
Please let us know how much you have borrowed , how much you have already paid back .Add the fees and principle to get one total paid back for each lender.

These are all internet.

Geneva, original loan was $300 have paid $360.
Plaza Processing, original loan $300, have paid $270
Loan Shop, original loan $300, have paid $370.
Big LTd, original loan $200, have paid $155.
Power Funding is the last one, original loan $300, have paid $300.

The have paids are the ACH withdrawls taken from my account.

Yes, I have a suggestion. You need to close your bank account. These are illegal pdls. Your state prohibits rollovers/extensions, which are what these pdls are charging you. Criminal action is prohibited in your state, so closing your account is an option. When are the debits due to hit your account next? You've got some nasty, ugly pdls. Not trying to scare you, but we've got to do something with your bank account first. We need to prevent these pdls from getting any more money from you. Read the "sticky" at the top of this site page regarding closing your account. If you have ANY questions at all regarding it, please post. :D

Good idea as usual Cannr, but lets let Mat read this first to be sure he can close it.Hope you dont mind me jumping in here, but I am so paranod about anything to do with banks

Before you close your bank account due to payday loans eating away at your paycheck, please read this.

Some banks have a policy regarding ach transactions that allows them to force open closed accounts if any ach transactions go through within a certain time frame after the account is closed. This can leave you owing a legal bank $1,000's and reported to chexsystems, instead of owing barely legal (or not at all legal) payday loan companies. Not a good thing. Ask your bank what their policy is on ach transactions on closed accounts before you close the account. It's best to go in person and talk to a branch manager.

If your bank does have this policy, tell them your situation. Don't be embarrassed. Take letters with you showing that you have revoked authorization for each of your payday loan companies to debit your account. Tell the bank to put your account on deposit only, an ach block, or a hard hold before they close the account. Your bank can do one of those, don't take no for an answer. This will prevent any payday loan ach's from reopening the bank account.

It'a always best to close your bank account. Leaving it open gives ways for the payday loan companies to continue to take money out. These companies have many different dba's, so blocking them won't work. They will also produce paper checks and run them through your account. Closing the account is the best way to prevent these companies from taking money out of your account.

Some state laws do allow for prosecution if you close your bank account, but that is usually in cases of fraud. But it's always best to check with your state's attorney general or department of financial institution before you close your account. You want to make sure you are not causing more heacaches!

Yes, you will need to send letters to these wonderfully illegal pdls. However, do not send anything (even an email) to them until your bank account is taken care of. If these guys catch wind that you're even thinking about closing your bank account, they are going to pounce on it and suck out every dollar they possibly can. So, you need to get your bank straightened out to the point to where you are "safe" from pdl debits. This is why I asked when are your debits scheduled to come out next. First thing is make sure your bank account is straight. No pdl debits can hit it. Whether that means closing it (and being assured it will not be forced open due to pending pdl debits) or putting a hard debit block/hard hold/freeze on it. Whatever to make it so that NOTHING goes through. Once you are "safe" regarding the bank, we can get to the letters. Can you take care of your bank situation first? Get that taken care of so that they can't get your money any longer. Then we can move on to the letters that need to be sent. :D

I, too, have a loan with Geneva Roth that I am no longer paying on. I would like to let you know that I filed a complaint with the OK Dept. of Consumer Credit and the BBB on them a couple of weeks ago. Friday, I got a letter from the OK Dept of Consumer Credit that orders Geneva Roth to Cease and Desist on loans in Oklahoma! Also to refund all principal and interest paid by consumers in Oklahoma! This may give you a little more ammunition and encouragement.

This is for matlocksrock - Got your pm and sent you the letter. If you have any questions, just ask. :D If you have email addresses for them, email the letter. If you have fax numbers for them, fax the letters. However, mail the original certified mail. Cover all the angles. Send it every way you can. But, beware. Once they get those letters and they start to realize their debits are being rejected, they're going to spazz out and try calling you to death. Try desperately not to take their calls. You want to communicate with them via email or USPS only. You want documentation of everything.

No, I haven't heard a word about getting my money back and I am not going to hold my breath. I also got a C and D about a month ago on Payday Cashlink. They did mark my account PIF, but no refund.
