i'm in Tennessee. I've been dealing with this place for awhile and tried to get them to help let me make payments on this loan. It's $280. Every time I go in, they are nasty and incredibly unhelpful. I've re-done this loan so many times because I just couldn't seem to get back up and going-- I was working on getting the others paid off that I had as well (because other places were helpful in letting me get them paid off, so I focused on them). Anyway, long story short, I re-wrote the check like normal. When I was involved in a car accident, I was unable to go in and re-write--- so, they called my work line (where I was not at) and harassed me, and then cashed the check, which bounced. I attempted to call and see what I needed to do--and the main girl that works there is no help at all, and raises her voice and interupts me every time I try to speak about coming in and paying off the check, and just keeps speaking of what they "can do to me" if I dont come in and pay it all right now. I'm in TN, so I was under the impression they cannot file any criminal charges.
I've not gone in to make a payment yet. I know I owe the money for the check. But I just haven't gone in because they are so incredibly nasty there. Anyway, they call me every day and leave a voicemail (they wont say where they are from in my voicemail, they just say they need me to call them back), and now they are calling my references, and claiming they are from Bank of America and need to get a hold of me, so I'm really annoyed that they are claiming to be from a different company when they call my references.
What CAN they legally do? Just take me to court over it? If I go in to make payments, they cant "make" me pay the full amount, if I dont HAVE the full amount!?

They are a legally operating payday lender, however, that doesn't give them the right to behave this way toward their customers, or anyone else for that matter. The thing is, these people are trained to behave aggressive, so reasoning with them is usually out of the question. If it were me, I would send them a letter with my intentions, certified return receipt requested, in that letter I would outline the fact that you were treated rudely by one of their employees, address it to the manager. I would also propose a payment plan that you can afford, do your best to get this loan paid off in a timely manner. With the letter I would include a money order with as much as you can possibly send, sort of as a good faith payment. Then, I would continue to send them payments as outlined in your letter. Make sure you keep copies of everything! By the time they decided to turn this over to collections or take it to court you will most likely have the loan close to paid off. And the more you pay, the faster the balance will go down, and your chances of being sued.

Don't waste your time with the store!

All that you need to do is to call the corp office, explain what has taken place and all will get better. The actions of the store employee are totally unacceptable and should be reported. Make this call and I would be willing to bet that this can get resolved very quickly.
