I am having an issue with Manhattan Processing. I opened an account with them for $300 in December 2011 with the intention of having them paid if full when I received my income tax refund. I have kept up my end of the bargain with the debiting $90 every 2 weeks from my checking account. However, on 01/25/2011 I sent a fax requesting they pull the full amount of $390 from my account. On 02/01/2011 I find that they only pulled $90. I emailed & called the company & was told that they did not receive the fax. I asked them to please debit the remainder of $300 do that I would no longer owe them anything. I was told that I would have to pay the entire $390 to satisfy my account. Of course I was livid and expressed so. I was sent an email that they could debit the entire amount on 02/16/2011.....so I'm thinking I will be done with them. Well, again today I check my account they have only pulled $90. I called and the lady that answered already had a bad attitude. I hung up and sent an email showing the conversation where I was told they could debit the full amount 02/16/2011. Well, I get a phone call later in the day stating that I did not authorize the payment in full and I could pay $310 by today to close the account. I refused because as far as I am concerned I have already overpaid $180. I sent them an email using the suggestions posted but I am wondering if there is anything else I can do. I want to file a complaint with the BBB but I cannot find any address info or any other phone number besides an 888 which is on the loan documents.
According to some info I googled this is what I found:
Texas payday loan laws prohibit lenders from dividing one loan into two loans for the sole purpose of collecting higher interest fees. The maximum term limit for payday loans in Texas is 31 days. The minimal term limit for payday loans is 7 days.

Under Texas law, a lender cannot pursue criminal charges to collect on a debt. Also, a payday loan lender is limited as to how many times a loan can be renewed. Currently under Texas law, lenders are allowed to renew a payday loan one time each month.

I really do not want to close my bank account as I have my paychecks direct deposited in to them as well as several monthly expenses directly debited each month (Insurance and so forth).

Any suggestions?

Closing down the bank account is one of the best options in order to stop Manhattan Processing from debiting money from your account. If you don't do so, they will keep on debiting money from your account. This is one of the big reasons why experts always advice people to not fall into the payday loan trap.
