Please list the names of the companys you owe, how much borrowed, how much paid. One of the moderators will be along to help you after you post the requested info. Sorry you are going through this.

Welcome...indeed a scare tactic and if these are 3rd party debt collectors, fdcpa violations galore with the disclosure of info to your family about why they are calling AND are you saying the letter they sent you actually said this?:
The FDCPA gives you 30 days to file a notice to demand validation of the debt with the collection agency.
I looked up Metro Collections and they are out of Colorado...you can google them. Is that who sent you the letter trying to collect for a pdl called Cash Zone?

The company you originally wrote the check to is the only business that can ask the DA to prosecute for the check. It's not the collection companies check so they cannot bring charges.
The spelling of your name or street name wouldn't have anything to do with it. It just shows the unprofessionalism of this company.
They are trying to scare you into paying up. They can't bring charges, only the original creditor can for the bad check.

The same collection agency called me today and said the same thing. Either PAY or GO TO JAIL!! So I called my local police department and asked them for advice. I was told by them to take payments in to the office in whih I borrowed the money form where I can obatain a receipt for my records. The officer told me to never wire money from person to person if you are trying to payoff a debt. I was told to wire the funds to a "Charles ???" in Dallas the same day. On another note the my county will call or issue you a letter letting you know a warrant has been issued for your arrest. If they are unable to contact you or you don't try to resolve the issue once the warrant has been issued then, and only then will they take drastic measures to come and arrest you. Call your counties warrant division and talk to them first. Its always comforting to know your rights. :lol:
Payday loan
i wa just reading about your experience with tha payday lender i have practically the same problem with one of these i got an e-mail from Legal Offices which it is a collection agentency trying to collect but they e-amiled me a Letter informing me that they had turned me over to the DA's Office here in my town and said that they had issued a warrant for me should i be worried?
The DA's office will not accept a check written to pay a loan.

Cash Zone
Has anyone else had any dealings with Cash Zone? They are a storefront in Texas. I borrowed $500 and have more than paid this amount in fees. I closed my account because i could no longer afford to pay it. They turned in over to Texas Credit Services, which is a total scumbag collection operation. I heard from them only twice, last time in November. The other day I got a phone call from their corporate office in Ohio from someone stating they are in the Fraud department and I need to call them right away!

Metro or Texas Credit Service in Texas
I received a call from an unknown number 2/9/2009 at approximately 10 am from a "Roy" with Credit Services informing me that I was a thief and that he was going to file charges against me today at Irving Police station. He also informed me that I should pay my bills and stop stealing. Then I received yet another call from an unknown number at 12:36 stating that they were Marshall Elliot from the state police department wanting to come and arrest me. He then advised for me to contact Brad Porter at Credit Services telephone number 214-750-0399 to deliver a payment in order to stop the arrest. He then started talking really fast and over me when I repeatedly asked for his contact information and badge number. He never answered me and hung up. I then called the 214-750-0399 and spoke with a David Kline. Mr. Kline sounded identical to the Marshall Elliot police officer that called me unavailable at 12:36 pm 2/9/2009. I informed him of my insight and he informed me that I was not correct. He then assisted me by telling me that I owed $480 and that the checks for the loan company totaled $360. He then advised that he would accept a cash payment of $450 to settle the case in full. I asked where to submit a cashier's check for this settlement and he advised very rudely and with much hostility that I can not come to them and that a courier would come and pick up the money from me. He began to become very rude and kept slandering me so I hung up. I then received a call from 214-750-7397. Whomever called hung up before I could answer the phone so I called back. They then informed me that the current person was Roy J Bond and that he was the person that originally handled the case. He informed me of the same things that Mr. Kline advised me of and I told him I would check with the bank and give him a call back. Not only have these persons harassed me, they have called my friends, family and job and advised that I am a thief and steal. Mr. Kline told me during our phone call that I was a con-artist. Due to the nature of the calls, the tone of all of their voices, the portrayal of police officers, threats, repeated calls and slander, I am afraid to leave my home. I have contact Irving Police Department for help.
Laws
I am formerly a civilian employee of a Texas county DA's office. You cannot be arrested or prosecuted for writing a "bad" check to pay these types or any other type of loan. No police agency will get involved with debt collections, so anyone representing himself as any type of law enforcement official is lying and should be reported to the State Attorney General.

Hey there. I live in Tarrant county. I copied and pasted the following from their website:
Many people think that every worthless check is automatically a criminal offense. This is not true. The person who is familiar with the distinctions will be better equipped to know when they should or should not accept a check. In addition, they will know whether to file a criminal complaint in the District Attorney's Office or a civil suit through their own attorney.
Under Texas Law, the District Attorney's Office cannot accept the following kinds of checks:
Post-dated, "Hold" or "Stop Payment" checks, (unless evidence exists to prove that the "Stop Payment" was used to prevent the check from being returned as a "NSF" check);
Checks upon which the statute of limitations has run, (2 years on checks under $1500.00, 5 years on checks over $1500.00);
Checks not presented to the bank within 30 days from the date written;
Checks for insurance premiums or service policies, where no claim has been made and paid on basis of the check, or no agent check for a premium has been forwarded on basis of the check;
Checks received through the mail;
Two party checks, (except payroll checks and only then when the original payee is available to testify in court);
Checks presented outside of Tarrant County or for services performed outside of Tarrant County;
Checks presented in payment of debts, loans, charge accounts, or other deferred payment accounts;
Checks given in payment due to a court order or other judgment, (special exception for some types of child support checks);
Checks where no property or services were given in immediate exchange;
Checks which are altered or forged, (file these with your local Police Department);
Checks given in furtherance of an illegal activity.
Generally speaking, a potentially prosecutable worthless check is one that is given in the immediate exchange for property or money, or is one given to induce the performance of a service or in special circumstances at the immediate conclusion of a service. If you do have one of the types of checks listed above, please be advised that you may still have certain remedies available to you under the Civil Laws of the state of Texas. Most of these checks can be filed in Small Claims Court, (J. P. Court), or you may wish to seek the advice of an attorney.
I am dealing with the same threats, from check n go, cash store and payday one. It looks to me after reading from the DA's website that since the checks were a- for a debt and b-post dated, that they will not prosecute you for this

I'm not sure how it works in your state, but I'm dealing with the hot checks dept. of TN (filing a check someone wrote to my work) and the process might be similar-
1. I had to sent a cert. letter return receipt requested to the customer and tell him I demanded payment in 10 days or would file it with the DA
2. I filed it with the DA when I did not receive payment and THEY sent him a leter saying he had 20 days to pay or a warrant would be issued.
They only issue the warrant after payment isn't received after these two letters. Like I said, it may be totally different in Texas, but that's how it works here

I worked at a payday loan company. Let me start off by saying that if you default on a loan the company cannot turn your check in for any criminal charges. The DA will not issue a warrant for your arrest because they do not accept held checks for a loan as "hot checks". However, they are able to file a complaint with the court and file a legal suit against you for the amount borrowed, any fees associated with the initial loan, late fees & nsf charges. Second, it is against the law for a collection agency or the payday loan company to make threats to you for debt collection purposes and under no circumstances should they call you names or falsely represent themselves as law enforcement. It is against the law to impersonate an officer! Do not let them intimidate you....call your local police station or DA & tell them your situation & find out your options!!!!
