No truth. You cannot get arrested or go to jail for defaulting on a payday loan. If you could, then over half of us on this forum would be in jail. What State do you live in? Who are your payday lenders? Are the loans via internet or storefront? If a payday lender is not licensed to do business in your State, then you are only morally obligated to pay back the principal balance (no interest or fees). Please provide this information and we can help you.

I was told I was going to be served with papers. they actually contacted former co-workers to find me. I simply told them to send me the info through the mail as per federal regulations, and haven't heard anything since.
Continue to hang up on them. They are blowing smoke.

(Just a few comments) WeALL have been through the PDL hell!! And I know it seems, at times, there doesn't seem to be a 'way out.' But..let me tell ya, there yes!! Whne PDL's are faced with people (us) who have a little bit of knowledge that they can't play the games that they want to, the PDL's actually DO back off!! NOOOOOO...you cannot be arrested for defaulted on PDL's. Actually............I didn't know, for a long time, that PDL's are illegal in the state where I reside (PA), until I came to this forum!! Thanks everyone!!

I was told today I was going to jail by Monday morning for internet fraud and check deception if I did not pay back 776.66 of a 400.00 loan my ex husband took out over the internet in 2009. The company that called me was 1st IRS Legal Department for Loan Point USA. I live in Indiana. What should I do?

My guess is that the company that called you is a phoney. There are scam artists out there that will call you and threaten you with jail time, etc. You can't go to jail for a pay day loan. Also, did you ask them for written proof of the debt. If they tell you its not required because it was an internet transaction, etc then they are lying. By law, if you request that they send you proof of a debt owed then they are to send proof to you.
I had scammers like that who pulled that kind of number on me even they I hadn't defaulted on anything. They were trying to get me to pay them $1400 and they would not provide proof of the debt, the exact date, etc. They wouldn't even tell me the company it was from.
I would report it to your local police or AG. They cannot threaten you with jail, etc as that is illegal in the Fair Trade COmmissions collection agency rules.
