I have a payday cash loan through the Cash Store in Texas. I am over my head and can not make the every two week payments. What happens if I do not pay this? They have a post dated check of mine with January 2011 on it. Please Help!

The Cash Store in a registered CSO in Texas. This means that they don't have to follow the PDL laws applicable in your state.

What you can do is, go to the store and ask for an Extended Payment Plan (EPP) which they, as a registered member of CFSA, are bound to give. If you can, go to the following link and print out the CFSA industries best practices rules and take it with you to the store: http://www.cfsa.com

Tell them that you cannot continue with the regular payments and want an EPP. You will be able to get it. Best of luck and keep us posted.

I defaulted on a Cash Store loan. They now have a collection agency, Asset Acceptance Management, calling and harassing me at work - asking to speak to my supervisors and all kinds of stuff, threatening legal action. They told me they aren't obligated to let me pay out anything or make any arrangements.

oh gosh, I have a loan in collections with them too, I mailed letters asking for payment options, but they did not respond. Now they're going to have to wait for me to pay them since all the other loan companies accepted the plans! its been 4 months and it hasn't happened anyhting to me but i jsut could not pay them and get back on track. I had a death in my family that affected my status, so, I'm still waiting for them to accept. all i've been doing is saving my letters to them where i ask them to please offer me a better payment plan just in case.... i wish you good luck with them but don't stop trying! oh and don't let them harrass you!!!!

OK, so I called the Cottonwood Financial CO. yesterday and they gave me some good information. My PDL at the Cash Store is due on Sept 20, the lady told me that if I dont go into the store and make my payment, they will try and do an ACH draft from checking account. She told me to contact my bank and let them know not to pay this. It will then go to their collections department. I am supposed to call back on Sept. 27th (this will give it time to get to them) and they will do 5 payments (every two weeks) @ $145.00 which will total the amount I borrowed. I will only pay the loan amount and not all the other fees. So I will have actually paid $725.00 instead of $1600.00 which is what I would have paid if I didnt ask for the EPP. Thanks to all who helped me with this.
