Theft by deception for defaulted PDL? Help!!!

I posted yesterday, but can't find the thread now.

I am in Texas. I had an online PDL with Dollar Flash. I defaulted on it.

Yesterday I got a call from a collection agency called MWS Financial, based in Houston, Texas, 866-330-4653. They said I needed to pay $550 or I would be charged with "theft by deception" and went on to say they were able to file these charges in the state of Texas if you don't make a payment on a loan. I know a little about the law and have *never* heard of this - but the collection agent spoke very good English and was well-spoken, unlike most of them. She kept saying I would be filed upon for returned items through my bank account, as though she was indicating they'd go after me for bad checks.

She then went on to say that if I do not pay, my 'date of service' will be tomorrow (Friday, July 8) and someone will notify my employer, and then come serve me at work.

I do not have $550 to pay these people, so here are my questions:

1. What is "theft by deception" and can I be charged with it for not paying a PDL?

2. I know Texas doesn't allow prosecution for bad checks on PDL, and I also know I never wrote actual checks for this loan. So, there is nothing she can do there, correct?

3. Is Dollar Flash legal in Texas?


both mws and dollar flash are bottomfeeders that have no business contacting you much less breaking the law with threats.first thing you do is file a police report as again the law was broken..by them!then file AG complaints against MWS.then ignore them,by that i mean do not talk to them.in fact don't be shocked when tomorrow comes and nothing happens except another call from MWS.file the report and complaints.then ignore them.

I did search to see if Dollar Flash had a CSO license in Texas (a requirement to lend in this state) and nothing comes up.

Funny thing is, I never heard a peep out of Dollar Flash!

I'm going to ignore them. I've already filed complaints against MWS with the FTC and the Texas State AG. I may also contact the BBB.

cool.do keep us posted.just know the threat of arrest(as theft is a crime)or immediate lawsuit are the two favorite threats of bottomfeeding humanoids.
