The Loan Shop - HELP
Date: Tue, 11/18/2008 - 08:10
I have been battling with my ilegal payday loan lenders for about 4 months now. I had taken out many loans with the loan shop before I realized that they were illegal and then decided to default due to the amount of money that I had already paid them.
I sent out all the necessary letters and did not hear from them for about 2 months. Then, last week, I suddenly had a charge on my NEW, COMPLETELY CHANGED, checking account for $260 from the loan shop.
I immediately called my bank and disputed the charge. The money (thank god) was debited back to my account and I then decided to do after the loan shop.
I sent them a letter stating that they had ILLEGALLY obtained my checking account information and had no right to debit that account, or any account I may hold in the future, and that I would pursue further legal action.
I then e-mailed this letter to them.
An hour later I received a response saying that they would consider my account PIF if I signed off on a waiver and faxed it in.
The document they sent me has someone else's name on it.
My question is, since Chase is now going after the loan shop to get the $260 they illegally charged me, should I sign off on the waiver and fax it in, or would such a document keep Chase from collecting from them?
