WOW!! They wrote themselves a check!

One of the illegal lenders that I sent ACH Revocation to called Red Leaf Lending NEVER responded to my request, however they DID stop the ACH last payroll. I have not received anything via mail or e-mail, but when I logged into my bank this morning I see that they wrote their own CHECK and tried to cash it yesterday!! $370.00 - my bank returned the check NSF - and I can see an electronic copy of the check online. It says NO SIGNATURE REQUIRED!
How can they do this??
They are not licensed in CA, they are not following the laws of California (by automatically renewing the loan and only charging the finance fee) I have already overpaid the principal by $142.00!!
Looks like I DO need to close my account that I have had for 10 years! :(

Okay, this is my post, I just signed up instead of having to type in a Username every time... Looks like I might be here for a while!

I am going on my lunch today to open a new checking account at the credit union and close my existing account.

I did not want to do that for a number of reasons, but mainly because I have set up an ACH payment plan on 2 of the payday loans that I had. They are supposed to debit my account tomorrow. When the payments don't go through I guess they will contact me and I can send them money orders, is that right? :confused:

The 2 companies I made payment arrangements with were legitimate lenders. They each agreed to debit $75 a payday for 4 paydays... the other 2 were illegal and one (tribal) wrote off the balance of $190 (which I had already over paid by $580) the other never responded and just wrote themselves this check!

So the legitimate companies will be in contact with me after the decline on their ACH tomorrow and I guess I will send them a money order....

I saw another post about pre-paid debit card payments?? What is that and how do I get one??

This is my first time hearing that this actually happend to someone. I always wondered if it would.

All of the companies that I've dealt with in the past (MyCashNow, PayDayMax, Plain Green, One Click Cash) had a clause in their "contract" that said (paraphrasing), "If you revoke our ACH authorization, you agree that we can present a remotely created paper check to your bank for payment."

The fact that it would've been paid if the funds were available means that this is somehow legal, which is scary as hell. That's why they preach "close your account" on these forums. It sucks that this happened to you, though. I hope you can recoup any funds that you lost as a result of this.

And when I log on to the main Payday Loan forum I can't see these posts since I created an account. Only when I click on the link from my history can I see them!

What do I do now?????????

I have 2 accounts with my US Bank, should I just have my Payroll deposit go to the other account at the same bank???

My employer requires direct deposit!!! :?::sad::?:

Hi,
So sorry this happened to you. First off: you also need to report this behavior to the California Dept of Corporations. Go to California.gov, go to the Dept's website, and fill out the complaint form which you can print off the site and send it to them in Sacramento. I was dealing with an illegal lender who was not only banned in California, but had the cojones to call me and say they were filing charges against me in court!! This is after I emailed them a copy of the Cease and Desist order from the state. I immediately filed charges with the state. Sent the form to them and got an email the next day saying they received it.

They didn't report you to chex; it was probably your old bank regarding overdrafts. I suggest you open a savings account at your local bank or set up an online ally bank money market - anything that gives you an ATM card. You can make unlimited ATM withdrawls with a savings account that provides you a debit card; you are limited to 6 for ACHs/Checks
