Need advice. I am working on paying off 2 of my pdl's now - these are two legal installment loans, so in my mind they are the priority right now....

Payday One is willing to offer a settlement or working out a monthly payment arrangement, although a supervisors approval is necessary. Think Cash on the other hand is not willing to alter their payments. They are willing to allow me to pay the past due amount and move one payment to the back of the loan.

Looks like I'm going to have to make a choice because I'm not able to pay the amount they are both requesting I pay.

Does anyone know if either of them use a collections agency who might be willing to collect on lower monthly payments prior to them suing me?

Sorry, this is new to me wasn't sure how to continually add to the same thread and ask questions regarding updated subject matters.

DeDe,

I found some very interesting info on Think Cash you may want to review!

Customer Experience
To date, the company has failed to eliminate the underlying cause of patterns of customer complaints.

Complaints brought to the company's attention primarily concern Billing, Service, Contract, and Advertising Issues. Specifically, consumers allege the following:

The company is not licensed to operate in the state they reside. The loan amount exceeds the maximum payday loan amount allowable in the state they reside.

In my opinion, since PayDayOne and Think Cash are the same company if one is willing to work a payment plan with you the other should in turn be willing to also.

Primary Contact: KEN REES (PRESIDENT)
Complaint Contact: MELISSA RIPPLE (MANAGER)
Phone: (817) 546-2700

Think Cash seems to have some licensing issues. They are based in Fort Worth, Texas, but their license is issued in Delaware. Im not sure if that is legal or not, so maybe someone here will be able to advice on that.

What does this mean to me? Would using this be a negotiation tool for this business to potentially offer me a settlement?

What about Payday-Loan-Yes. I sent them a C&D and they've called me leaving messages on my voice mail at work and on my cell phone a week after receiving the C & D. now I'm getting calls from an Andrea who says she is with the legal department of First National.

In regards to Think Cash not being licensed and legal as a pdl and not following the laws of pdls that would be correct-because they are not a pdl- they are in installment loan and therefore the pdl laws do not apply to them at all. They cannot be treated like a pdl.

This has been addressed many times in DeDes numerous threads. I feel like these threads are going around and around in circles with the same information being posted. If you would keep all of your posts in one thread then everyone can keep up with whats going on and what advice you've already been given and build on that. Its also helpful for others in the future doing research.

Is them violating a C & D and misrepresenting themselves a violation?

Think Cash is an installment loan company backed by the First Bank of Delaware. So they do not need to be licensed in their homestate being that they harbor the laws from DE. Totally different than payday loan laws. Do not get them confused. Bottom line you have to follow the agreement listed in the contract even though it sucks! They can pursue legal action in civil court. Best bet is to work out a payment arrangment or request loan deferral payment plan.

Here is a post I started a while back on clarifying rules and regs regarding installment loans. This thread also clarifies your question regarding their home licensing for Think Cash.

The thread is called "Installment Loans Regulating Law" and just click on the name to read more.

As Paul stated Paydayloan Yes is highly Illegal. So all you owe them is the principal. Hope that helped clarify
