I wrote a letter to one of the payday loan lenders to request for them to close my account because it was brought to my attention that payday loans are prohibited in the state of AZ. I received an email back from them with in 24hrs. that they have closed my account. I did request money back because I have over payed them over $5,000.00 in interest. This is the response I received. Can I do pursue further action and if so how?

Plain Green is owned by the Chippewa-Cree, and operates exclusively on land owned by the Chippewa-Cree. As such, Plain Green stands as an “Arm of the Tribe,” in the view of the United States state and federal courts. Therefore, loans made by an arm of a sovereign Indian nation are not subject to state law. This is NOT a payday loan.

This letter is written to help you understand that Plain Green and its loan contracts are governed exclusively by the laws of the Chippewa-Cree.

Pursuant to your request, we have removed your contact numbers from our system and we will make no further ACH debits from your account.

Just keep annoying the crap out of them for a reufnd. Try to use your bank to get money back via filing unauthorized charge ACH/stop payments.

Dear Plain Green Loans

I do not live on your reservation and I am not a Chippawa Cree...thus I am not subject to your laws, only the laws of the state I reside.
