I received a phone call at work today from a man named Steve Wilson for an online payday loan that they withdrew out of my account in Sept. He told the girl that answered the phone that he needed to speak to an employee there that he had a criminal summons for from the court house in my town. She told him to hold on, and put my supervisor on the phone. he told my supervisor the exact same thing. and left his name and number that if I didnt call him back by 5:00 then he was coming to my work and embarrassing me in front of everybody with a warrant for my arrest. He told her he was calling from the County Clerk's office at the court house (but the caller id said Texas). I called him back and he refused to talk to me. He transferred me to somebody else, who admitted that he was in violation of several codes for the Fair Debt Collections Act. He gave me the supervisor that said there was nothing she could do unless I had him recorded. Then my son-in-law called me and said he had called him and told him that I was going to be arrested for bank fraud with my bank and he was trying to find me by 5:00 or I was going to be arrested. He then left a message on my daughter's voice mail that he was trying to get in touch with me because I was in trouble for bank fraud on my bank. The message he left was about 5 minutes long. I then called him back and he talked to me like I was an absolute DOG!! and kept telling me to hold on he had another call and would not come back to the phone. Can someone please tell me what I need to do about this person. He told my receptionist at work, my supervisor, my son-in-law, and my daughter that he was going to serve me by 5:00 today with a summons or possibly be arrested for bank fraud. Is this legal???? Please help!!


To start off with, what state do you live in? Things vary by state. Then on to the good stuff. DO NOT DELETE the voice mails. If possible get the supervisor and girl that answered the phone to sign an affidavit stating what the guy said, same for your daughter and son in law. If possible record any further conversations. File a complaint with the Federal Trade Commision and your states Attorney General. Try and find a lawyer locally that will sue the people for such grievous violations of the Fair Debt Collections Practices Act. Your state's AT and the FTC I'm sure can help you more on what to do next.
