I took out a loan through MY1Direct a couple of years ago. I now have a guy by the name of Allan Miller from United something claiming he is in their legal department. He told me that by me taking out this payday loan over the internet it was a felony for something like taking money over statelines and also a civil matter. He also said that if I did not pay them by Wednesday that they were going to have the cops come to my place of work to arrest me. I tried to tell him that according to New Mexico law I could not be arrested for not paying a payday loan and he told me to call the local police and ask them. I am very worried and scared because I have children at home. I tried to tell the guy that I could pay him $100 a month, but that is all I could afford because I am supporting a family of 8 on my income alone and I don't make that much after taxes. Even forking out $100 a month is going to really put me in a bind. What can I do because I can't afford a lawyer, yet this guy practically calls me 4 to 5 times a day. Is there anyone that can help?
Just the fact that he said they were sending the cops to arrest
Just the fact that he said they were sending the cops to arrest you tells me this guy is scum. You can not be arrested for a debt. It's a civil matter. I don't know anything about NM payday loan laws or this company. But don't worry and do not give him any information or admit to anything. Someone will come along with more precise advice.
