So here I am with so many others that fell into the payday loan trap... moving on. I am in Arizona. I have read many posts on here (wonderful info, thank you all!) and I'm not in TOO bad of shape but it's bad enough and I don't want it to get worse and will never even THINK about a payday loan again. I have read enough info on the first lender, MyNextPaycheck, and have already closed my account, emailed them, got a response and am effectively communicating with them via email only. I owe them $120 towards the principle (which is all I will be paying them, if they provide me a mailing address to send payments). I am confident with that situation. My next loan is different..... I can't find enough info on here to know what to do. PLEASE HELP!
I got a $700 loan from Plain Green, LLC (Plain Green Loans, Chippewa Cree Tribe in Montana). I haven't made even one payment on this yet. I closed my bank account due to the MyNextPaycheck loan and therefore, Plain Green Loans didn't get their ACH debit either. They called me at work and informed me there is now a $35 fee on top of the 1st payment I owe since they weren't able to debit my account and asked me if the funds would be there for the next scheduled payment. I was at work and told them I would have to get back to them on that..... They said they would be emailing me by Friday and I didn't receive any email. Ok so here's my questions. What can I do??? From the few things I've found on here, they are NOT a payday lender but a installment loan lender so does that mean I can't send them the letter about payday lending being illegal in AZ? Can someone help me with how to get the ball back in my court so I can send them payments (as I can afford) to pay back the principle on this and keep them from calling me at home and especially at work and keep them from harassing me or wage garnishing? Any advice is much appreciated. Thank you!

I will suggest you to immediately contact Arizona Department of Financial Institutions in order to find out whether or not Plain Green LLC is licensed to operate in your state as a payday lender. If they are not licensed to operate in your state, then they cannot take any legal actions against you and you'll be liable for paying only the principal balance to them.
