This is what I said:

This contract is invalid, secondary to payday loans being illegal in north Carolina, therefore I only owe the original amount borrowed which I have already paid above and beyond.
Again, I am revoking any authorization of an ach withdrawal on my account. If you do so, I will be forced to report this offence as stealing.

Is this going to work? I bank with BOM, and I can't close my account because it's negative. I've heard that they won't stop an ACH from going through even if you do close the account anyway.



I already sent this letter to cashnet and they took out the money after the first one bounced. I'm due to pay them again Friday, as well as payday-loan-yes and peppercash. Peppercash has not responded to my revocation letter (the one on this thread).


I've already paid payday-loan-yes and peppercash $1000's over what I should owe them.


I appreciate all the advice, but I guess I'm just not sure what to do next.


their positon is BS.your state law prevails and if as you said paid over the principle then not only do you not owe this totally illegal lender,but they owe you.btw have BOM put your account on DEPOSITS ONLY status.that way nothing new can add more NSF'S.also file AG,AND FTC complaints against paydayloan yes as they are a most illegal lender.anything they email will contain nothing but lies and BS.file the AG complaint,and forward any further emails to your AG.

Regarding your question of jurisdiction, in your signed loan agreement you acknowledged that we are a Costa Rica company that registers and operates under Costa Rica law which both parties have contractually agreed to abide by. As was specifically stated in your loan agreement, the loan was provided in accordance with the Laws that govern licensed lenders in Costa Rica and the loan was approved and funded in Costa Rica. As such, we do not maintain a location in the State of North Carolina and are not registered with or subject to any other state agencies.

Having stated the above, we understand that many people are experiencing difficult times. So, while we are not obligated to do so, and in full and final settlement of your grievance and any claims you may wish to assert against us, we will agree to a settlement of $472.50 to be completed in four payments of $118.12 each (10/7, 10/21, 11/4, and 11/18). Agreeing to this settlement will freeze any interest or fee amounts currently outstanding. interest or fee amounts currently outstanding.


To finalize this settlement option, please reply ?I AGREE? in the subject heading. Peppercash sounds like mypaydayloan.com a bunch of bullshitters. Don't be fooled your state laws prevail against them too and they are not even legal you are in Costa Rica please come get me! I know with me mypaydayloan.com sent my account to a collection agency I sent a debt validation letter certified with return receipt I also filed complaints against them and the illegal company and they left me alone. Sometimes it feels akward to have all my monies to myself but it is a great feeling. The people on this site have empowered me to take a stand and don't back down. They will fill your head with a bunch of nonsense but let's see them go to North Carolina and try to take you to court and see how far they get and who wins. Like Paul said put your bank account on deposits only and open another. They will try to go in under different names even wrote fictious checks with your old account deposit only the account you have and change them.

I'll "second" what the others have said; continue sending those letters and get that account put on deposit only status until you are able to close it out. Don't we all just LOVE those replies which say we're subject to the laws of Costa Rica, Malta, etc? I told 'em to come and get me, I'd be waiting.
