Ughhhhh!!! Effing Cash Call

So, I took out a Western Sky loan in June which was immediately sold/transferred to Cash Call. I have NEVER missed or been late on a payment. My payment for this month (February) was due on the 1st, however, I was planning on making the payment on the 17th. This didn't happen as I had other, more important expenses (although Cash Call thinks they are the most important bill) like car payment, groceries, etc.

So, fast forward to today, they had called my 7 times by 12:30 so, even though I don't get paid until March 2nd, I thought that I had better call them and make arrangements so that they could stop harassing me. I call them and the man with whom I spoke (Justin, I think) was rude and unhelpful. He as well as another representative refused to take a post dated check over the phone saying that "it's too late in the month" for a check and saying that my only options are to pay with a debit or credit card (for $9.95) or send a MoneyGram (for $6.99). I was also told that if I did not make my payment by 11:59 PM on February 29, my account would be reported as being 30 days past due to the credit bureaus. I kind of figured this and did want to avoid it but what am I supposed to do if I don't have the money?

Anyway, I just wanted to know if others have had this experience with CashCall and if anyone has had any sucess in having them removed from their credit report. I have already filed a complaint with my AG's office and disputed the account with both EX and EQ so I'm really hoping that they can be removed. Just looking for other's experiences, with hopefully positive outcomes. (sorry so longwinded, had to vent).


I do know that they're illegal and I have already filed a complaint against them with my AG's office. I was actually advised by the person who is working on my other IPDL complaints to file a complaint with them and did so at that time (around late December or early January). My account that they were using has already been closed and they do not have my new account information. I was loaned $1,500 although I only received $1,000 due to the $500 "origination " fee or whatever they call it. As of last month, I have paid them $1,146.70.

Seeing as how they are illegal though, how are they able to show up on my credit reports? They are on both Experian and Equifax. I have disputed the account with both bureaus citing the fact that they are an illegal lender and under investigation by my AGs office. If they were not on my credit report, I would seriously be telling them to eat it, (which I pretty much did, I actually got really nasty with them and they haven't called back), however, given that they are on 2 of my 3 reports if I elect to stop paying them, it will adversely affect my credit. Any ideas on how to get them off of my credit? Also, should I send them the illegal lender letter?

you owe this piece of crud nothing further.let's review

1)this was an illegal loan
2)the 500.00 origination fee is crap.you only recieved 1,000.00
3)you paid 1,140 plus meaning you owe nothing further

dispute any further entries on your CR and ignore any further calls,emails,etc.again you owe nothing further and should not pay another dime on this illegal loan.

I sent them the illegal lender letter so I'll post their response (if they bother to respond). I also filed complaints with the FTC regarding the fact that they are reporting to my credit as an illegal lender and filed a separate complaint about them charging $500 for me to receive the loan.

My question stands about the credit report though-how exactly do I address the fact, other than through dispute which I've already done, that an illegal lender is reporting on my account activity? As far as I'm concerned, I'm pretty much forced to pay them as long as it's showing on my credit. Anyone have any success in getting this removed?

did you file complaints with your AG?if not do so.you should have disputed this the minute it was passed on to cashcall,but you can with your AG'S help get it removed.

They did respond by saying that they are unable to help me unless they speak with me directly. Clearly that is NOT the case as I spoke with 3 different people on Tuesday who were unable to help me.

I have filed complaints with my AG AND with the FTC (two complaints with the FTC actually, one for them illegally reporting to my credit and one for predatory lending).

I have also filed disputes with Equifax and Experian which are still being investigated but since this is still on my credit report, I really feel like I'm stuck paying it at least until it's removed.

I'm actually on the phone with cash call right now! They are horrible! I find it very sneaky that they hide behind Western Sky! I just finished my conversation with Cash Call, and they said that they respect the fact that I feel the way I feel with only paying back the principle amount I owe, but I signed a contract and that I can speak to whoever I need to speak to, but that will not be getting out of my contract. Western Sky nor Cash Call is licensed to loan in Nevada. When I stated this they said that Cash Call didn't lend to me, Western Sky did, and its perfectly legal for them to sell the loan to Cash Call. Where do I go from here? I filed a complaint with the BBB, and the FTC. Nevada's AG's office told me that if its an illegal loan company, then obviously they aren't going to go by legal practices. What do I do now?

You say that you've talked to your state AG but have you actually filed a complaint with them against Cash Call? I have been working very closely with my AG's office and they sent me an email this morning saying that they are currently investigating CashCall and have litigation pending against Western Sky. You can do a Google search for Western Sky litigation and Martin A. Webb who is the principle of the company (and several other tribal pdl) to see that other states have been successful in getting these companies to cease collecting on debt. So I highly suggest filing a complaint.

The BBB won't do anything about a complaint against an illegal company...

I am glad I am not the only one involved with this crooks. I have filed complaints with the AG's office here in my state of Texas. I have also filed complaints with the BBB, the FTC and the Bureau of Consumer Credit. I am not going to stop until I get resolution in this matter. They just don't seem to care and seem to be untouchable. It's very frustrating.
