I reside in New York and I requested a loan from Western Sky on two different occassions. Once in December of 2011 in the amount of $2,600 and again in April of 2012 in the amount of $2,600. After reading about Western Sky on this site I decided to send to file a compaint with the BBB and the FTC and Credit Bearua. Yesterday I received an e-mail from the BBB stating Western Sky would not respond to their calls. So I finally decided to send W.S. an e-mail revoking my ACH debt and I also fowarded a copy to Cash Call. Here is a copy of what was sent:

It has come to my attention that payday loans are prohibited in New York State. Therefore, the loan contract that I may have signed with Western Sky Financial, LLC, according to New York State???s laws, is not enforceable. Although I am not required to do so, I am willing to repay the principal balance of the loan to the Original lender Western Sky Financial, LLC. To date, I have received a deposit of $2,525.00 and have made one payment of $175.50 and another payment of $294.46 leaving a balance due of $2,055.50. I am also deducting the overpayment I made on the first illegal loan dated December 22,2011 with Western Sky Financial, LLC in the amount of $776.75. I am willing to repay the the total remaining balance of $1,278.75 in monthly installments. I am expecting receipt of the last and final payment that the account be marked as " Paid In Full."

At this time I am revoking ACH authorization. You are no longer authorized to withdraw payments from my checking account. I am also revoking any and all wage assignment I may have signed. I have given a copy of these revocations to both my bank and my employer. Any future attempts to collect funds in this manner will be blocked.

Please contact me to set up payment arrangements as outlined above.

So today I received an e-mail of the contract they claimed I signed. But prior to that I received a copy of a contract they claimed I signed via USPS. I comparing both contracts there are several discrencies with the dates and the figures. I also stated to Western Sky and Cash Call that I never signed any such contract with them and that if they did foward me any such documentation that the document would be a fraud. They have proved me right. What can I now do with the copies of the forms I have and who should I foward them to? The contract itself is invalid and hold no weight. Write to them again and repeat what you just said, no ACH, just principal repayment on your terms. Also mention that the loan was originated by an illegal tribal lender and that since you are under Federal jurisdiction, you are not bound nor subject to tribal laws. Ask for the PIF letter again. If they reply in the positive, carry on with the payments, if not, forget about it and file complaints with the FTC and the AG.
