Got a call today from Valerie Thompson with the "legal division"
877-629-1155. Left me a message stating that she has been ordered to process documents to be served.
I did call and spoke to here and she stated that Fox Enterprises has hired them to mediate to prosecute for fraud and or cold check charge.
(I live in KY. My dealings with Fox is another story..)
I didn't give them any information about me and simply told her that it would be ok to process the summons to be served as we should let it got through the court system here in KY.
I looked up the company and called, yes she is in fact there.

So, do I have reason to worry here or not?
I did receive a loan from Fox. They never sent me the loan agreement. I made one payment and then found out that they were illegal in KY. Still, I attempted to contact them to send revoke letter and c&d. Never a response from them. I even offered to pay the principal with a proposed re payment. No response.
So am I getting served/sued or not?

Even the Pakastani people manage to put something together that looks a little easier on the eyes. Also, we are in 2012, not 2011. (Reference to copyright) Usury is the practice of lending money at an insanely high interest rate. It's illegal. Many states require lenders to be licened in their state if the interest on the loan exceeds a certain amount. From there, the terms are pretty much black and white on what they can and cannot do. Is the lender "tribal" by chance? If so, tell them to stick it. They knew going into it the loan wasn't legal. You owe the principal only and even that is just a moral obligation that people cannot force you into - unless as part of an ongoing attempt to settle outstanding payday loans with tribal lenders and regulate the industry current borrowers are given 12-24 months to repay the principal balance. That's just a hypothetical as it likely won't happen.

Fox Enterprises is not tribal that I am aware of. To be honest, I haven't been able to track them down at all. I understand that they are one and the same with Apollo Funding, but the three addresses that I could find for them have returned mail. I never did receive a loan agreement from these folks, just a phone call.

Waffles, Thank you. Many of your posts have been so helpful in digging my way through this ordeal.
Since I have had no luck getting a C&D to Fox Enterprises, I suppose at this point it is mute, right? I tried the Apollo Funding addresses and they all came back. I have tried to search for this King Marketing and can't find anything that looks right. Do you happen to have anything on them?
Apparently they are going to try to appear to be collecting through third parties and from what I have read may hassle me from a couple of different angles.
In your experience, what is the best way for me to deal with this one?
