Still have not heard anything from Plain Green since - 10/15 telling me their offer from 10/7 that I need to pay $537, even though I have over paid them by $1002.

What do I do next, or just wait and see, I was emailing them weekly, do I need to continue. Or just ignore and see what if anything they do?


You can mail them or ignore them, the outcome will eventually be the same. These idiots will hand over your 'account' to one of those scamming bottomfeeding PDLs which operate offshore and a few months later, you might get calls from people threatening to arrest/sue you.

I say you hammer them with more demand mails for a refund of the amount you overpaid. That usually puts a cork in it.

Have to chuckle a little - after sending weekly emails for over a month this is the response I get back from Plain Green this morning.. I have included my email to them from today - notice I even wished them a Happy Thanksgiving :) I have never used another email with them, so I guess I no longer exist in their system? :D

Let me start by saying Happy Thanksgiving, maybe we can get this resolved this time?
I have sent numerous emails in the attempt to resolve this issue. All I am asking for is in lieu of me asking for a refund of the over payment on my accounts with you of $1002.89, I am asking for a PIF statement on the last account #64970928, that you are saying I still owe $537.50 in principle. If you do the math here you will still be, $465.39 ahead of the game.
I will also be forwarding all correspondence to the BBB and the Montana Attorney General's Office.
Below are the emails that have gone back and forth with your company.
It has recently come to my attention that in the State of Arizona, USA, Plain Green Loans is not licensed to offer loan products to its residents, thereby making it illegal to do so. I have been unknowingly participating in illegal loan activity and no longer wish to do so. Therefore, I no longer wish to conduct business with Plain Green Loans. Prior to this discovery I had been a good customer; I was never late, had paid off one loan and was allowed to borrow a 2nd time.
Because of this relationship, I am requesting that my account be marked as paid in full, and that the account be closed from any further collection. With the two loans that I have with your company: To date, I received 2 deposits of $800 each, one on 11/15/2011 for one on 8/10/2012, and have had 17 bi-weekly withdrawals of $130.57 , 1 withdrawal of $120.70 and then 2 more bi-weekly withdrawals of 131.25 debited from my account. This resulted in an over payment of $1002.89.
Although I feel that I am entitled to a refund in the amount of $1002.89, I am willing to make Plain Green Loans a good faith offer. I will forego all efforts to seek a refund of$1002.89 in exchange for Plain Green Loans considering my account paid in full, thereby dissolving our relationship amicably. As I said earlier, I simply no longer wish to do business with Plain Green Loans.
As previously stated, in the original email dated 10/2/2012: I am also revoking authorization for ACH withdrawals and any wage assignment I may have signed. I have given a copy of these revocations to both my bank and my employer. Any future attempts to collect funds in this manner will be blocked. I demand that any contact be made through US Postal mail or email only. I will need everything in writing to keep accurate records of all communication as per instruction from my state Attorney General's Office. I prohibit you or your affiliates to contact me via telephone at my place of employment, my home or cell telephone number. I also prohibit you from calling my references listed on my loan.

This is how I chose to respond to their stupid email from earlier post.

To whom it concern,

I guess this means that I can consider this matter closed and my account marked PIF, since you can no longer locate me in your system under the only email that I have communicated with you from since day one.

stop paying them. They are NOT legal. They are tribal now. If they have your email, get a new one. If they have your phone, get a new one. If you have not shut down your bank account, do it and get a new one. If you wish to pay them the principle amount they borrowed you, that is up to you. It sounds like you have already done so by quite a bit. move on

She did stop paying back in October. She was trying to get a PIF letter and/or refund on the amount overpaid. She was giving us the information the Plan Green sent her stating that they have no record of the loan or overpayment.

It would also help if you registered so we can give you credit for correct answers as well. I have read several posts by an unregistered user that are correct and very good in the information they contain. If you are registerd make sure to log in before posting so you get credit for what you post. I for one am more likely to ignore advice from an unregistered poster then from one that is registered.

As has already been stated below in many of my email communications with you, I demand that all communications be done via email or mail. So, I will not be calling your office, there is no reason that this communication can not take place via email, so that I may have a record of our communications.
And again since you are unable to locate an account with my email address associated. I can only assume that I can consider this matter closed and my account marked PIF, since the email that I am using is the only email that I have communicated with you from since day one. You can see the emails below from our communications. I will be forwarding this communication as well as all others on to my local Attorney General's office, as well as the Attorney General's office for Montana.

Got this from them today - I called and they are so stupid, He says to me we have all of your numbers and email blocked.. OK -

We forwarded your email to legal, which from the fact that he also stated to me that they offered me a payment arrangement - I would gather means legal = account services - since they are the ones that offered to allow me to pay them yet another $537.50 in 5 installments - even though between the 2 ,loans I had with them I have already overpaid by $1002.00

He said they would be in contact with me - I asked how since you can't see my contact information. He said well you did email us, I said you mean the email that you can't associate with any account there and can't seem to read or respond to?

I wonder if this means that they are going to attempt to collect another way? LOL

Just got this email from Plain Green - today -

Your email address was removed from our system on 10/15/12 because you advised us you no longer wanted to receive email notifications for upcoming payments.
We have now reinstated your email address so if you do reply, your correspondence can be directed to the correct department.

They are referring to email from 10/7 -
Dear Ms. :
Your correspondence has been directed to me for review and I thank you for the opportunity to assist you at this time.
We understand that all situations are different and would like to offer you the opportunity to pay the remaining principal in the amount of $537.50. We will accept five (5) monthly payments in the amount of $107.50, beginning October 30, 2012 and monthly thereafter. Payments made on prior loans were paid according to the contracted rate and will not be applied to this loan.
To further clarity your questions regarding the legality of this loan, Plain Green is organized under the laws of the Chippewa-Cree Tribe of the Rocky Boy?s Indian Reservation of Montana (?Chippewa-Cree?). Plain Green is owned by the Chippewa-Cree, and operates exclusively on land owned by the Chippewa-Cree. As such, Plain Green stands as an ?Arm of the Tribe,? in the view of the United States state and federal courts. Therefore, loans made by an arm of a sovereign Indian nation are not subject to state law. This is NOT a payday loan.
This letter is written to help you understand that Plain Green and its loan contracts are governed exclusively by the laws of the Chippewa-Cree.
Pursuant to your request, we have removed your contact numbers from our system and we will make no further ACH debits from your account.
Please reply if you would like to accept this settlement and set up payment arrangements.

Dear Plain Green,

Do yourself a favor and mark my account paid in full. I am not paying you another cent - you owe me a refund. If you charge me off to collections I will not hesitate to not only cease and desist them, but make them aware that I informed you I am aware of the illegality of the debt and the fact that I will not be paying it. Cut the crap and save yourself the time.
