I have two PDL. One through Kenwood Services and one through DJR group. I closed my account back in July when I saw other fraud on my account. I contacted them and made them aware of this and requested a place where I could send in payments. However no response. Long story Short CDR and Associates contacted me telling me my loan of $250.00 is now up to $1,146.23. Also they have the file for DJR group and thats up to $1,626.11 for a $300.00 loan. I am unsure on how to handle. CDR is telling me that I need to make a payment arrangement. Which I am willing to do to pay off this debt. Yet the amount they want down is $562.00 and $200.00 a month. If I do not agree than I will have two Civil Matters in Cook County Courthouse? Is this legal? I have payed a few renewal fees I think four or five on each but never paid down the loan. They presented to the bank on numerous times a whole bunch of amounts to withdraw. They all were returned and thats why they are tacking on all these fees for NSF's. Reading on here looks like it is only two allowed for state of IL? HELP I am so lost?

I wouldn't agree to ANYthing until you receive documentation in the mail. Tell them, they now have 5 days (after the first initial contact with you) to send you a dunning letter (letter of collection) in the mail per the FDCPA. At that time, you will have the opportunity to request debt validation, which means they will have to prove that they are legally able to collect that debt, how they computed the interest and fees, and some type of documentation that shows you actually signed or agreed to obtain this loan to begin with.
