I would not call them back at all. The conversation can swing out of control very quickly with these companies. You absolutely should send your proposal letters via email, fax, or USPS as soon as possible.

Thats what I thought, I do not want to feed their criminal minds. So I now will prepare my letters for all of them stating what I will pay them ( principal balance only) Is there a sample one here I can use?

Stay off the phone. Once they get you on the phone they'll pull out every (fake)threat in the book to try to rattle you and get you to pay more than you should. Trust me on this. Caller ID is a wonderful thing. If you must answer the phone, hang up the moment they identify themselves as a debt collector. It's not worth the stress, seriously.

After doing research regarding Internet payday loan laws in the State of _______, I have found that your Internet payday loans are actually illegal. I have also found the following laws to be true applying to payday loans in the State of _____ in general:
Your State Information
I hereby revoke any and all ACH authorizations with your company from debiting any of my personal accounts, per Federal law, Regulation E Section 205.10 Preauthorized transfers. I have closed my account with the XXXXXX to protect my interest in this matter, per instructions from The _____ Department of Finance. I also revoke any and all wage assignments I may or may not have signed with your company, I no longer authorize you, your company, or your affiliates to attach any part of my wages or contact my employer for your collection purposes. I have notified my employer about this matter so any attempts to do so on your part will be rejected.
I demand that any contact be made through US Postal mail or email only. I will need everything in writing to keep accurate records of all communication as per instruction from my Attorney General's Office.
I prohibit you or your affiliates to contact me via telephone at my place of employment or my home
telephone number. I also prohibit you from calling my references listed on my loan.
Due to the fact that Internet payday loans must be licensed in the state of ____ to be a legal and binding contract, your company should NOT issue loans to ____ residents at all. I am requesting that you send me your license number which enables you to offer loans to ____ residents.
The legal amount that could have been charged to my loan is the principal amount, even IF your Internet pay day loan were legal anywhere in the U.S.. I am willing to pay the principle amount of the loan only, however, this is only if you provide me with a physical address where I can send payments.
I must also inform you that I will be filing complaints with the Better Business Bureau, the Federal Trade Commission, and the ____ Attorney General's Office.
I expect a response from your company no later than 5 days from the above date regarding this matter. This response may only come via US Postal mail or email. No telephone contact is permitted.

I added to my letters that I wanted to be contacted ONLY via e-mail or U.S. mail; that I was not permitted personal phone calls at work. I changed my cell phone number (you might want to change your house phone numer if you have one). I received 2 calls at work and stated I could not receive calls, then hung up. I tried to negotiate with the collector for Eastside Lenders.....they just run you around in circles. I faxed my proposal but never received anything in writing accepting it.
Received lots of e-mails from US Fast Cash. Others just simply "vanished" once I sent the letters and my ACHs didn't go through. Even got a refund from one.
It's best for your stress level not to speak to them. Trust me.....

I agree on the stress level, I am now seeing a doctor because I dont sleep or eat. So I am going to do my best to not get into any verbal communications with them. The one thing that has really made me feel better is the Attorney for the Depart. of Corps. has spoke with me and she is completely behind me and said she wants to use my situation for when they go back to court May 2010. She was telling me these people are just like the mafia, sometimes worse. I know this web site is the only reason I am not going to lose my house or car, cause I was unable to pay them after these people got done with my check every payday.
You just hang in there and relax. I was like you, not sleeping,
You just hang in there and relax. I was like you, not sleeping, worrying about paying these loans and keeping my household bills up to date. Once I took care of my bank account and stopped the drafts, I felt immense release. Except for speaking with one collector, I haven't had to talk to any of the pdls.
I've now moved on to settling credit card debt. I'm doing it myself with the newly found confidence I gained from this site and from dealing with the pdls. I've settled 2 credit card accounts so far; got payment arrangements on two others.
For the first time in many many months, I can sleep, laugh and feel like I've got my life under control.
Keep us posted.:p

Yes, email them and don't call them, there's no need to speak to them on the phone once you send them the letter above, all they will do is harass you and threaten you, the less you acknowledge their phone calls, the better the chances the phone calls will stop, the more you speak with them, the more they will call, don't give them ANYone to argue with, just state the facts.

Keep in mind that these lenders aren't licensed so they will stop at nothing to TRY to get to you. They are nothing more than criminals so I wouldn't expect too much from them. It would be GREAT if you could somehow explain to your employer that these loan sharks are harassing you and there isn't anything you can do about it except file complaints. Maybe you can even get someone to tell them you are no longer employed there. It WILL eventually stop but your guess is as good as mine when that will happen.

All of my PDL's have gone away except for one who tries every so often to get in touch with me. I have caller ID on my work phone so when I see their # pop up, I lift the receiver ever so slightly and then place it right back down. Listen to what Shazzers says, don't talk to these people if you can possibly help it; they'll use all kinds of double-talk and threats they can to try and intimidate you.

Pursuant to my rights under the Telephone Consumer Protection Act (TCPA), you are hereby forbade from contacting me by telephone. CAN original creditors be forbidden to contact you by phone? I thought that only applied to third party collectors! As I only have one PDL left who spordically calls me, if I could tell them they are forbidden to call, that would be great. Of course, it's a company run by good old MNE/MTE, so I don't know if they'd pay any attention to me.

I was thinking it applied to unsolicited advertisements, I don't have time to read all of it now but here is the link if you want to read it over:

You might try emailing them (the cease and desist letter) repeatedly as many times as you can, it might prompt them to respond and by responding there will be no question they received it, even if they respond telling you to stop emailing them. All you really need to know is they received it, just in case.

True, I always used freefax.com, just don't use your employers fax or they may decide to fax threatening letters to your employer, plus it confirms where you are working.

I'm curious about your experience with VIP. I recently paid Fast & Reliable in full. While I may have overpaid, I opted to cut my losses and received confirmation in writing that the loan had been paid in full. My bank account was closed by my bank and I've since reopened a new account. I have made arrangements with Check n Go and Advance America and will continue to pay an installment loan from First Bank of Delaware. I have two additional loans with VIP and CashDirect Express and need to deal with them regarding the past due balance as well as payment arrangements for the remaining balance. Jasgal, please let us know what you hear from VIP. I received a call from "Angie" this morning on my cell phone, but have been unable to return her call and after reading some of the posts, I'm hesitant to do so.

As of now, I have only been getting calls from Integrity and number that says is for CPD. I dont know who they are call for. VIP is the one I have paid a total of $1202 on a $600 loan. I know they owe me money back but I would be completly happy with a PIF status. To be honest I am a complete mess right now. I will keep you updated on my contact with them. I think you may not want to call them back. Cause it can turn ugly when speaking with them. Please let me know how things go for you. I do know there is a great deal of support and information here. Best of Luck.

Shazzers, as always thanks for the information!!! I'll have to sit down and read those telephone regulations myself; however, seeing as I'm dealing with an MNE/MTE PDL, I'm sure if I'd give them these regs, they'd say as they're on tribal land the regs don't apply to them. :(

The part that makes me the maddest about claiming the Tribla Land excuse is when Congress made laws protecting Tribal groups I dont think they were thinking of letting them commit crimes and get away with it. Any other person would go to Jail for their behavior. And I think it is really sad that they would want the rest of this country to think of them as criminals.
Shazzers, thanks for the information; I'll have to plow through
Shazzers, thanks for the information; I'll have to plow through it and see if it applies to my situation. Even if it does, considering I'm dealing with an MNE/MTE PDL, I'm sure they'll say they're not affected as they're located on tribal lands.

A guy named Jason from 866-378-0084 called my work and I acted like it was not me, he left a mess to call back, I asked was this personal or business, he said personal and that I would know what it was about. I advised him that personal calls were not allowed at work, and not to use this number again. He said ok, so we will see. 2 seconds after that call he calls my cell and leaves another mess asking me to call him. He was all nice and calm on the phone. I expect these calls to get meaner soon

Tell "Jason" that under the TCPA, you demand he stop calling. Record the call and tell him you're doing so.

Yeah I know, quoting laws to illegal lenders are much like telling Jack the ripper he was a naughty boy and to stop murdering people.
Thanks

Just have to say thanks for the laugh! I have been having a rough day already and your quote just made me laugh out loud to the point where people are looking at me funny.... I know that I "created" my mess and I am cleaning it up but like so many others on here sometimes it feels as if it will never end with all the harassment and such and this quote just seemed to put in all in the right perspective today! Thank you again!:D
