Here is a stunning revelation! While researching a couple of internet payday lenders on BBB website, I found that at least 8 companies were found at the same location, each apparently run by the Miami/Modoc Nation Indian Tribe. All are apparently illegal, as they are not licensed in OK.

AmeriLoan
USFastCash
United Cash Loans
Paycheck Today
Cash Advance Network,
MTE Financial Services
Instant Cash USA
500 FastCash

The following are excerpts from the Tulsa, OK BBB website:

AmeriLoan is located at the same address as USFastCash, & United Cash Loans. A subsequent BBB investigation determined that this address is the address for offices of the Miami Nation Indian Tribe. During its investigation of these companies, BBB employees visited the location as well as sent a certified letter to the Chief of the Tribe asking for further information regarding these companies. Employees of the Miami Nation Indian Tribe neither confirmed nor denied knowledge of the loan companies, and informed BBB staff that they would have to speak to the Miami Nation Indian Tribe's Leadership concerning the matter. BBB has not received a response from the Chief concerning this matter. At the present time, BBB does not know if these companies are operated by the Tribe, by employees or other people using the Tribe's addresses, or is a joint venture between the Tribe and a for-profit company.

The complaints against this company and others located at the same address generally allege the inability to pay off the requested loan, charges to the consumer's checking or credit card account despite never receiving the requested loan, or continued unauthorized charges to the consumer's credit card or checking account once the loan has been paid off.

BBB has determined that this company is not licensed in the state of Oklahoma to provide loans to consumers and does not appeare to be licensed in any of the states from which consumers have filed complaints with BBB. However, if the Miami Indian Tribe actually operates this business, it may not be subject to state laws regulating this industry.

A BBB investigation of this company determined that Paycheck Today is located at the same address of the Modoc Nation Indian Tribal Office. During its investigation, BBB employees visited the location as well as sent a certified letter to the Chief of the Tribe asking for further information regarding this company. The investigation revealed four other loan companies (Cash Advance Network, MTE Financial Services, Instant Cash USA, and 500 FastCash) are located at a smoke shop/casino operated by the Modoc Nation Indian Tribe. An employee of the Modoc Nation Indian Tribe was reluctant to speak with BBB staff but confirmed Paycheck Today does operate out of the Modoc Nation Indian Tribal Office. However, he did not provide further information. BBB has not received a response from the Chief concerning this matter. At the present time, BBB does not know if these companies are operated by the Tribe, by employees or other people using the Tribe's addresses, or is a joint venture between the Tribe and a for-profit company.

What's even crazier is that I had loans with both US Fast Cash and 500 Fast Cash and I got a form letter as a response to my BBB complaint saying that as a courtesy, 500 Fast Cash was waiving my remaining balance and I can no longer do business with them (even though I already paid the principal and in fact overpaid by $200). Then US answered my BBB complaint by saying that my account is going to collection (I also have overpaid them as well). I guess they only wanted to admit defeat on one loan. LOL

wndy,

I have found out that four of the companies I am starting to go after are all from this place in Miami, OK and they are all illegal to give loans to Illinois residents (which I am). Ameriloan, United Cash Loans, ACE Cash Services and Paycheck Today. What was the process you went through to get your loans zeroed out? Did you start by making a BBB complaint? Or, did you send them a cease and desist letter like it talks about in this forum? Please advise, as I am just getting started.

Stacey,

I just made complaints with the BBB concerning the ones I mentioned. There were two others that I contacted the Ohio Attorney General and the Delaware State Banking Commissioner. I got different results using each tactic. A few of the BBB complaints I sent were not answered by the companies. I had 9 total payday loans with 4 having PIF designations, 2 marked as unresolved by the BBB, 2 still in the process, and 1 left to have the principal only repaid. I would say use any and all avenues available to you, whether it is a BBB complaint, state banking complaint, FTC complaint. It never hurts to have more ammunition than you need to go after these illegal companies.

Give them time, if you stand your ground they will come around. These lenders are nothing more than criminals.
