Hi I live in Minnesota, and had taken out a payday loan with Sagamore for $300.00, over the course of a few months I ended up paying them over $690.00. I found that they were not a licensed lender with Minnesota, and since I had over paid, I sent them a letter and an e-mail in November advising them they were lending illegally, revoked their ACH closed my account, so on and so forth. Never got a response from them. A few weeks ago I am contacted by HZB Financial who apparently bought the account from Sagamore in December. I mailed HZB Financial all the appropriate information showing it violated state laws, sent all the letters and e-mails that I had written. Anyway HZB mysteriously has not recived the letters and I have to fax them all the documentation now. My question is that I do not know if Sagamore is owned by a Native American Tribe or not. If they are I am wondering how I should handle the collection angle, since I know my state laws dont apply to them, but their laws do not apply to me and I could wait it out but I also do not want HZB harassing me 24/7 looking for the documentation that I keep sending and they mysteriously loose. Any suggestions would be helpful, also if anyone knows if they are owned by a tribe or not. Appreciate it cause I am not giving a dime to this HZB, I know they are just collecting on what they think is a valid debt, but I think they should be mad at Sagamore for selling them a bogus debt, but instead they blame me :( oh well, live and learn, also wanted to thank all of you will the helpful information as I had about 9 payday loans out and have paid/settled with most of them using this information down to one, which is United Cash Loans, which I anticipate to be a pain in my behind since they are on tribal land. but this Sagamore Corp, will not go away!


The way I am reading this post is, the only letter of collection you have received from them is via email? If so, then that is not acceptable. You need to inform them that they are required by federal law (FDCPA) to send you a dunning letter in the mail within 5 days of their first initial contact with you! At which time you can send them a request to validate the debt and deny owing them anything. Remember, any communication with them should be send certified, return receipt requested! This PROVES they received it and there is no denying it.

Frankly, I would not be too concerned with this debt, obviously this collection agency is not legit or they would have followed the laws to begin with. If they do call you, don't speak to them, hang up immediately, their only purpose for calling you is to scare you into giving them more money with bogus threats.

Thanks Shazzers, They did get the fax, i should say HZB did, I also faxed them the mn laws as well, I had not heard a thing since I faxed the documents on january 24th. I did however get a letter from them yesterday offering a settlement on the account. I am going to ignore it because I know they got the stuff so i have retained all copies and fax recipts pertaing to this in case we end up in court because i refuse to give these people another dime. I do want to thank you Shazzers and other people who have given great advice, if it wasnt for you guys I would not have known what to do I was drowing in payday loans and still only have one united cash loans, not too worried about them and been reading about everyone elses experiences with them. I appreciate it and am doing my part as well, for everyone I even overhear speaking of obtaining a payday loan, i quickly educate them that its not worth it thanks guys and keep up the good work :)

I took a payday loan out through Sagamore about 2 years ago and I have been lately receiving threatning calls recently from a Ms. Douglas from HZB Financial leaving voicemails on my employer phone saying their is pending case against me concerning check fraud. I am assuming that it is in regards to Sagamore, I never answer the voicemails, and Iam not allowed to receive personal calls at work.Is their a fax number or an address or HZB Financial that I can send a letter asking them to not contact me at work? and can they take me to court? if I have never received anything in writing from this company validating the debt I owe to them.

You need to tell them they are required by law to send you a dunning letter (letter of collection) in the mail within 5 days after their first initial contact with you, that is a federal law (FDCPA). They should already know this but are probably hoping you don't. Don't admit to owing any debt over the telephone and tell them you are not at liberty to discuss this alleged debt with them until you receive the proper documentation in the mail, also tell them you are not permitted to receive any personal phone calls at work and if they call again after being told this you will be forced to file a complaint with the FTC. I'm not sure if they will honor this request (I doubt it), but after you tell them this information and IF they attempt to call you again hang up immediately without saying a word to them.

I am recieving phone calls from a Jennifer Hammond an "investigator" for HZB financial......she is threatening to go forward with further legal action today if I do not get back to her. I had a loan with Titan group for $300 and had some problems with my checking account so I closed it. I have not recieved any letters about who to pay or try to settle this with except for this woman from HZB. She called me on a Sunday evening at about 8:30 p.m. she has called my work and discussed the information with a fellow employee. Can she in fact take further legal action? She mentioned a $1500 fee and was very threatening in the phone call. I told her I was going to check out her information to see if she was a ligitimate collection agency. She didn't give me the full address just a part of it and the address she claims they sent a letter to me was close but incorrect for an address I had lived at previously that Titan would not have had. What can I do to get her off my back?

I took out a loan with this company about two years ago for 500$, I lost my job and didnt have the money to cover the loan when they tried to debit my account, so after I recieved my first N.S.F. fee from the bank , I contacted them and told them my situation and that I would gladly repay the loan in full if they would give me a few more days and to not try to debit my account again as it was already in the negative. They agreed, but to my surprise, the next day I recieved yet another phone call from the bank with another N.S.F. and then another the next day, they continued trying to debit my account for seven days in a row costing me hundreds of dollars in N.S.F. charges. I eventually had to close my checking account just to keep from incurring any more charges. Then I recieved a threatening phone call from some attorney saying they were going to take me to court if I didnt settle the account immediately. So I did, I payed these guys almost 1,000.00 to settle the matter and considered the case closed. Now all of the sudden, yesterday I get another phone call from them saying I owe another 370.00 for returned check fee's. Is this ever going to end? should I pay it?

whoever is calling needs to be reported to the police,and your AG.in fact never just pay a voice over the phone as the idiot you paid before was just a dope saying they were an attorney.this was an illegal loan and you already paid the 500.00.which is all you really owe.do not even think about paying this new loser.report them,and ignore them.
