So...a phone call here to work turned out to be a hang-up. I *69 it and got a Delaware number, 302-791-9666, which I called. The "gentleman" on the other end simply answered "may I help you"?

I stated someone just called my place of business and hung up on me, to which he asked "whats this about", and I stated, thats what I am trying to find out!

He was like, well maam, we are a legal collecting agency for Payday loan Yes, do you have a loan out with them, i said yes, an illegal one, as they are not licensed in Florida. I owe 35.00 and nothing more. He stated "why would you take out a loan on a contract if you knew it was illegal", and from there it was downhill, me accusing them, him insulting me saying it was "crooks like me" that make the world the way it is, etc. I hung up and said do not call me at work again. Two seconds later, the work phone rings, it was him, I did not state my name, just the company, could have been my boss answering, he didnt know, just started spouting off about what a lowlife I was, etc. and I responded by pretty much cracking up, it was so funny to me, guess that wasnt the desired effect, so he gave one final parting shot, after I said.."now you are going to the FTC for abusive practices" he was like..."whatever, WHATEVER" and I may have stated some expletive and hung up. Unreal! But it is kind of funny...and now I am going to really let them have it.

Well, if this "gentleman," and I use the word advisedly, calls again about your debt, ask him to send you something in writing on company letterhead stating that it is in fact a legal debt in your State, see what he says about that. I think a "C&D" letter to his company would be a good idea, as well so they don't call you at work.

I will do just that, AND I will send a hard copy of the C&D email I already sent out, thanks for that, too.

I did have another question...what about the Oasis Marketing phone call? They did in fact send me an email agreeing to zero out the loan if I agree to not file a complaint with the AG, saying it would cause them too much "paperwork". But if I agree to that, am I doing a disservice to others that might now know to look for help and take this on?

There has been a lot of new posts regarding payday loan yes collection tactics. They seem to be on warpath. I asked them to send me something in writing and they hung up on me. I have not heard from them since. I saved all the threating messages they left on my voicemail.
I am reporting them to the AG and FTC.

That's a typical 'paid in full" agreement from illegal lenders. That would be your call. If you want them off your back and are tired of dealing with them, go for it. Just make sure you KEEP that PIF email from them in case they decide to sell your debt to some bottom feeder collection agency in the future.

Help! Have you seen this language before? Is it legal as they are not licensed in NH. I have already paid Payday Loan yes the principal and more. I already sent them the C & D and asked them to supply me with a copy of license and a validation of the debt.

Governing Law
"Both parties agree that this Note and your account shall be governed by all
applicable federal laws and all laws of the jurisdiction in which the LENDER
is located, regardless of which state you may reside, and by signing below
or by your electronic signature, you consent to the exclusive exercise of
regulatory and ad judicatory authority by the jurisdiction in which the
Lender is located over all matters related to the Note and your account,
forsaking any jurisdiction which either party may claim by virtue of its
residency".

Isnt it though? It really does give you peace of mind; these lowlifes operate on intimidation tactics just like these mentioned, hoping that human nature will make us just give in, too afraid to stand up. They must hate this site, LOL!

Well they may hate it but it has helped me gain a strength that I didn't know before. Because of this site not only am I almost completely done with payday hell..... I am working on other debt AND I have started actually working through a budget. It is my hope that by continuing on with posts that I am able to pass on that strength to other people! (Oh yea and I have let go of a lot of the shame/guilt that used to wake me up at night! It is n ice to know that I was not the only one that got into the situation and it's nice to have someone who blazed the trail of survival before me!)

Amen to that...I am working towards getting rid of these pests and then getting back on track with my budget. Im not too bad off; I had a hysterectomy in August and was out of work for two months. Thank God I had some benefit in the form of disability but it was only 65%...which doesnt sound like a bad deal but when you live paycheck to paycheck...I got further and further behind, hence the payday loan situation. Now Im just waiting for tax refund and to pay everything up to date, make a budget and stick to it.

Im going to poke around more forums too, to get the tips and tricks I need to help.

On another note...just got another phone call from...you guessed it...a "female" this time, from PDLY! They dont give up. She informed me that I had a balance of 640.00. Amazing really since I was loaned 350.00, have paid back 315.00! I just laughed but forgot my script, and didnt ask for a written document. All I said was ::::chuckle:::: i have contact the BBB and Atty General in this state and in yours ::::chuckled again::::.
At least she didnt call me a name, she just beat a quick retreat and said "k thanks bye"

Another phone call this morning! I stated not to call me at work per the C&D and my comments yesterday...she told me "I will call wherever I want until you pay this money" and I laughed an hung up.
I called law enforcement to report harrassment, the cop was so nice and sympathetic, but basically said he couldnt go up there, to Delaware to arrest someone....but he DID make contact. Unreal! These people called the cop a CLOWN, accused him of lying about his identity, YELLED and laughter at him. Poor guy was furious by the time he hung up! He is going to make a report and Im calling Delaware Law Enforcement now...this is just crazy! I will, as ever, keep you posted...

Read all the posts above; they tell you how to deal with all of this, including how to protect the assets you have in the bank.

Its been a few days with absolutely no contact from anyone out of the three. I think the C&D and consistent lack of desired reaction to the threats makes them give up. Either that or I will get something in the mail from an atty! LOL...I doubt it though...the original amounts have been repaid. Thank you guys so much; Im learning alot and hope that this downturn in my finances recently is short lived. One day at a time I am digging out.

Pay Day Loan Yes is definitely on the warpath lately..a few months ago The Barr Group aka The Bam Group called me and when they realized I wasn't falling for it they went away. Now I have some bottomfeeder called Absolute Resolutions calling me. They never ID themsleves I found their info on 800 notes so I guess I skip traced them hahaha. Anyway the number for them is 619-564-6499. Just a heads up for those of us dealing with PDLY. This Absolute Resolutions place is completely unprofessional and rude. The collectors must have a 3rd grade education max.. I keep telling them I'm ready for them to "pursue the matter" and they get mad and hang up on me. Happy V-Day everyone and enjoy your Sunday!

My guess is that there out a lot of money and I mean a lot to get to this point. I had a place call me the day. Once I informed them I was recording the phone call for legal matters the guy said well I'm closing this file out as a refusal and sending it back. Long story short, I don't think they wanted to deal with me at all.

Well, they arent out alot from me, thats for sure and from what I have read they have taken hundreds beyond thier principal amounts from several hundred people. Oh well. I just hope that everyone learns about this illegal entity and the ...well...the rectal muscles that work for em!

They can only "garnish" your wages with a court order and due to the fact they aren't even located in the U.S. that will never happen, however, they can "attach" your wages with a "wage assignment". When borrowing money from a payday lender they usually place a clause in the contract which states you will allow them to "attach" your wages if you should ever default on the loan. The good news is, this wage assignment can be revoked at any time, all you need to do is shoot them an email which states you are revoking their rights to a wage assignment, then print out the copy of the letter and take it to your employer. Your employer MUST honor your revocation, it is the law.

As far as stopping them from debiting your account, you can't really, as long as they have your account information it will never be safe again, you need to close it.

Im on a reduced schedule until I train someone, there are several of us that fill in so they never get me. The one time they did I simply said "she doesnt work here any more" to which they responded "oh i think she does and I think its YOU and Im just going to keep calling back". I am in payday hell here too! But because of this sight I had sent all illegal lenders a letter revoking my wage assignment and ACH authorization and that my checking was closed. Pay Day Loan Yes had someone call me from their collection dept - First National. Their message stated I must call at once regarding a court appearance!!! I did call back and once I explained that PDL's were illegal in Connecticut, and I am only obligated to pay what I borrowed - which I more than willing to do - unless she can send me her CT license to lend # and debt validation letter she screamed it wasn't illegal when I was spending the money and hung up! Would love to see them in court - I have paid them hundreds more than I ever borrowed!!!

you won't ever see them in court unless somebody is suing them.they are not licensed anywhere,and totally illegal.file AG complaints against this bottomfeeder.then do not speak to them again as by what you posted not only do you not owe them.they owe you a refund.they don't deserve the time of day,and you shouldn't give it to them.
