I am pretty freaked out. I took out a 200 dollar payday loan with Ace Cash and have not been able to pay. A Mr. Simon has been calling me non stop tellin me I have been warned...and that I have to notify him by 130 pm today. I have already asked, repeatedly, if I can set up a payment plan(I am in the state of TX), and have been told no. I do not have the 500+dollars that my account is now up front, but yet I can not set up a payment plan. I am easily scared, and did not want to have to take out a payday loan to begin with but needed to for school tuition and had no choice.

Does anyone know the proper way to handle this...when I call what should I say? Where can I read up on my rights. I DO want to pay but simply can not pay in one sum! Does anyone know of an Ace Cash represntative they have worked with in the past that I can contact.

Anyones help will be greatly appreciated.

Send them a letter with the outline of a plan to pay them back. Explain your hardship and pay them as much as you can afford, ei. 50.00 every two weeks, something you CAN afford. With the letter include a good faith payment, via money order. Send this letter to them certified, return receipt requested so you will have proof. Continue to send payments until the loan is paid off. By the time they take this to court or turn it over to a collection agency you will probably have it mostly paid off, and if it does go to court you will have proof that you were trying to pay off this debt, this will show in your favor.

Okay so I can be taken to court over this? I have talked to a representative from this website actually, through live chat, about debt consolidation. Is this the best way to go? The calls I get are extremely harrassing and put a hole in my stomach every single time.

I guess I am just trying to figure out what I should/can do. I'm worried, and do NOT want to be brought to court over this. Is debt consolidation gettin me in more over my head. Any and all advice is so helpful to a very freaked out young girl! thank you :)

Ace Cash Express is licensed in your state. Yes, they could sue you in court for the loan, this is why I suggested making payments. Why wait for them to approve a payment plan for you when they'll push for the entire amount at first, and who knows how long they will stall, by that time you could have it at least paid down. That's what I would do.

Okay earlier I saw a sample letter I could send, but now I can't find that...is there one on the site? I am not great at this...also is it good to consolidate, I just soke with someone about that...it seems like it'd be worth it. Im just not very smart when it comes to al of this :(

what ever you do dont pay full amount if mr simon is calling that means its in collection company hands right know and you should pay the no more than your original payment I had a 600 note that with interest was more than 800 they have been trying to settle for 400 save your money and talk them down.if they wont work with you now maybe they will in a month or 2 when they find out your serious about non payment.
